SUBJECT: NRC EMERGENCY PREPAREDNESS INSPECTION REPORT NO. 50-

346/96011(DRS)

Dear Mr. Wood:

On December 18,1996, the NRC completed an inspection at your Davis-Besse site. Also,

Subsequent to the end of the onsite inspection on November 8,1996, a December 18,

1996 telephone conference with your staff indicated that they were unable to identify any

documentation allowing deviation from the backup EOF commitment. The enclosed report

presents the results of that inspection.

Areas examined during the inspection are identified in the report. Within these areas, the

inspection consisted of a selective examination of procedures and representative records,

interviews with personnel, and observation of activities in progress. The purpose of the

inspection was to determine whether activities authorized by the license were conducted

safely and in accordance with NRC requirements. The summary contained in the report

provides an overview of our assessment of your performance in the area of Emergency

Preparedness, an aspect of Plant Support.

Based on the results of this inspection, certain of your activities appeared to deviate from

your written commitments in correspondence dated December 6,1982. This is specified

in the enclosed Notice of Deviation (Notice). We are issuing this deviation because the

Toledo Edison corporate office in Toledo, Ohio had been designated to the NRC as the

backup location for your Emergency Operations Facility. However, no provisions for the

facility were ever developed, and the Davis-Besse Emergency Plan was not modified to

indicate the location of the backup Emergency Operations Facility.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter,

its enclosure (s), and your response, will be placed in the NRC Public Document Room. To
