OF APRIL 18, 2013, MEETING WITH DUKE ENERGY CONCERNING THE NATIONAL FIRE PROTECTION ASSOCIATION (NFPA)-805: "PERFORMANCE-BASED STANDARD FOR FIRE PROTECTION FOR LIGHT-WATER REACTOR ELECTRIC GENERATING PLANTS" (TAC NO. MF0956)

On April 18, 2013, the Nuclear Regulatory Commission (NRC) staff conducted Category 1 public meeting with Duke Energy, Inc., at One White Flint North, 11555 Rockville Pike, Rockville, Maryland. Duke Energy Inc. is the licensee for Catawba Nuclear Power Station, Units 1 and 2 (Catawba); and McGuire Nuclear Station, Units 1 and 2 (McGuire); and represented Carolina Power & Light Company, the licensee for H.B. Robinson Steam Electric Plant, Unit No.2 (HBRSEP). The purpose of the meeting was for Duke Energy to discuss with the NRC staff its proposed license amendment request (LAR) for Catawba, McGuire, and HBRSEP regarding the transition to a risk-informed fire protection program based on the National Fire Protection Association (NFPA)-805: "Performance-based Standard for Fire Protection for Light-Water Reactor Electric Generation Plants." The meeting notice was publicly available on the NRC's website and is documented in Agencywide Documents Access and Management System (ADAMS) Accession No. ML13072B202. NFPA-805 describes a methodology for existing light-water nuclear power plants to apply risk-informed, performance-based requirements and fundamental fire protection design elements to establish fire protection systems and features required for all modes of reactor operation. The performance-based approach enables licensees to make plants safer by incorporating risk insjght into developing and maintaining their fire protection program.

During the meeting, the licensee presented information regarding the NFPA-805 transition project, the milestones for the LARs, and the fire Probabilistic Risk Assessment (PRA) sensitivities overview for Catawba, McGuire, and HBRSEP. Specifically, the licensee stated that the development of the LARs for Catawba and McGuire is in progress and that the fire PRA quantifications are complete for both sites. For Robinson, the licensee indicated that the LAR development will start in May 2013 and that the fire PRA quantification is in process.

The licensee indicated that for Catawba, compensatory actions are being implemented as needed to comply with the requirements of NUREG-0800: "Standard Review Plan for the Review of Safety Analysis Reports for Nuclear Power Plants: LWR [Light-Water Reactor]

Edition." Respectively, for McGuire and Robinson the licensee indicated that compensatory actions are being implemented as needed to comply with the requirements of Appendix R to Part 50: "Fire Protection Program for Nuclear Power Facilities Operating Prior to

-2 January 1, 1979," of Title 10 of the Code of Federal Regulations. Duke Energy's presentation was followed by the NRC staff's questions and the licensee's responses. During the meeting, the NRC staff discussed its overall expectation of the LARs, scheduling, and asked a few clarification questions.

The NRC staff specifically noted its concerns with the licensee incorporating the acceptable methods approved by the staff to complete the NFPA-805 transition. The Nuclear Energy Institute (NEI) and the industry developed guidance for implementing the NFPA-805 risk-informed program that the NRC staff has endorsed along with some exceptions and additional clarifications. The NRC staff has developed guidance and is reassessing current guidance for newly identified issues. The staff is using its publicly available "frequently asked question" process to discuss such issues and their resolution. The licensee indicated that they are improving the LAR submittals by following the NEI templates, the industry operating experience, the NRC guidance, and the requests for additional information (RAI) for other NFPA-805 submittals.

In terms of scheduling, the licensee is planning to submit the NFPA-805 LARs for Catawba, McGuire, and Robinson for NRC staff review by September 2013. The NRC staff discussed with the licensee, the NFPA-805 review process that includes the acceptance review, RAls, site audits, and the development of the safety evaluation. The NRC staff also indicated to the licensee that the overall review of the LARs could take 2 years.
