SUMMARY

OF NOVEMBER 30, 2022, PUBLIC MEETING WITH DUKE ENERGY CAROLINAS, LLC REGARDING ITS PROPOSED LICENSE AMENDMENT REQUEST FOR MCGUIRE NUCLEAR STATION, UNITS 1 AND 2 TO ADOPT TSTF-505, REVISION 2 AND 10 CFR 50.69 RISK-INFORMED CATEGORIZATION AND TREATMENT OF STRUCTURES, SYSTEMS AND COMPONENTS (EPID L-2022-LRM-0084)

Dear Mr. Pigott:

On November 30, 2022, an observation public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) staff and representatives of Duke Energy Carolinas, LLC (the licensee) via a webinar. The purpose of the meeting was for the licensee to discuss its plans to submit license amendment requests (LAR) to adopt Technical Specifications Task Force (TSTF-505), Revision 2, traveler for the use of risk-informed completion times (RICT) and to voluntarily adopt 10 CFR 50.69 for risk-informed categorization and treatment of structures, systems, and components (SSCs) at McGuir e Nuclear Station, Units 1 and 2.

The meeting notice and agenda, dated October 25, 2022, is available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML22298A070.

The NRC staff questioned the licensee regardin g the upcoming submittals and identified the following information that should be addressed in the submittal:

1. The PRA history for acceptability should be clearly presented to include items such as: were focused scope peer reviews performed congruent with Appendix X for Findings and Observations (F&O) enclosure, and, if so; were subsequent F&O closures performed to close findings identified as a result of focused scope peer review.
2. Where credit for Diverse and Flexible Coping Strategies (FLEX) is applied in the PRAs the submittal should identify proposed differences, if not, the LARs should be clear that credit for FLEX across all models is consistent.
3. The NRC staff understands that the licensees 10 CFR 50.69 LAR platform intends to include an alternative passive categorization methodology. Such a methodology would be considered during the acceptance review period by the NRC staff as a first-of-a-kind approach.
4. Site-specific plant level fragility should be used for Seismic Core Damage Frequency (SCDF) calculations and site-specific containment fragility should be used for Seismic Large Early Release Frequency (SLERF) calculations.
5. Appropriate technical justification should be provided for use of the non-standard method for delta SCDF and delta SLERF calculations presented in the meeting.
6. Evaluation of the impact of seismic-induced Loss of Offsite Power on the RICTS should be provided in the TSTF-505 LAR.
7. The licensee confirmed that configuration specific conditions will be considered for any external hazards applied in the TSTF-505 LAR and those conditions should be delineated in the submittal.
8. Due to a non-standard request, the NRC staff will review the acceptability of the high wind PRA and any high wind penalties that are presented for use in the TSTF-505 LAR. The licensee should also st ate in the submittal the appropriate enforceable mechanism to ensure the use of either high winds PRA or high winds penalty, but not both, during the implementation of the RICT program.

Additionally, for those RICT configurations where the licensee proposes to add a penalty for high winds and where screening criteria from Part 6 of ASME/ANS PRA Standard is exceeded, the application should include justification, along with results from sensitivities performed, etc. that provides complete understanding why the use of a penalty factor is appropriate and bounding for the limiting conditions of operations are proposed.

9. Any SSCs that are necessary for screening out any hazards should be categorized per the guidance in NEI 00-04, 10 CFR 50.69 SSC Categorization, April 2004, (ML041120253).
10. The licensee should apply Electric Power Research Institute (EPRI) report, Alternative Approaches for Addressing Seismic Risk in 10 CFR 50.69 Risk-Informed Categorization, February 2020, (EPRI 3002017583, ML21082A170) to support its Tier 2 seismic alternative approach in its submittal.

No regulatory decisions were made as a result of the meeting. No members of the public were in attendance and no public meeting feedback forms were received.
