" Response to Notice of Violation" ESK-97-099 Page 1 of 2 STATEMENT OF VIOLATION: Inspection Report 50-254/97004(DRS): 50-256/97004(DRS) 1 NOTICE OF VIOLATION: ,

During an NRC inspection conducted between February _10 and March 26,1997, a violation of .

NRC requirements was identified. In accordance with the " General Statements of Policy and . .

Procedures for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the violation is listed -

below:

Secton H.3.E of the facility Operating Licensees DPR-29 and DPR 30 for the Quad Cities Nuclear Power Station requires the licensee to maintain in effect and fully implement all provisions of the Commission approved physical security plan, including amendments and changes made pursuant to the authority of 10 CFR 50.54(p).

Section 9.4 of the Quad Cities Security Plan (QCSP) requires that motor vehicles with authorized protected area access be searched prior to entering the protected area. Areas that are searched ,

include, in part, the passenger compartment / cab. Section 7.4 of the QCSP requires the implementation of a vehicle search procedure.

The search procedure, Security Post Order No.14, requires the search of accessible compartments in vehicle passenger areas for unauthorized material.

Contrary to the above, on February 10,1997, an NRC inspector observed an inadequate search of a vehicle. The officer failed to search an easily accessible storage compartment located under the driver's seat.

Comed acknowledges this violation. The reason for the event was personnel error. The Security

- force member did not properly search a vehicle entering the protected area.  ;

ATTACHMENT A,

" Response to Notice of Violation" ESK-97-099 Page 2 of 2 ACTIONS TAKEN:

The following actions have been taken:

  • A " Lessons Learned" memo was issued for all security personnel. This memo contained a description of the event, the lessons learned, and a review. The memo was read and signed by all security personnel.
  • The Vehicle Picture Book, a tool for use by the vehicle search ofTicer, has been revised to include the compartments and storage areas of all designated vehicles along with some examples of"over the road" vehicles. The previous version of this book did not contain all designated vehicles. Pre and post shift meetings were held to discuss the Vehicle Picture Book and it's purpose.

. The Appendix "B" training for this area has been enhanced. The training reminds security force personnel to have a questioning attitude while conducting searches, i.e. Did I see or search a battery compartment? Did I get to the engine? Did I find the fuel source.

  • The contract Security force manager held pre and post shift meetings with the security force to review this incident as well as discuss all areas ofingress search. Security force members were reminded to self check using the S.T. A.R. (Stop Ihink Act Review) program.

ACTIONS TO PREVENT FURTHER OCCURRENCE:

None.
