Dear Mr. Gipson:

SUBJECT: FITNESS FOR DUTY INSPECTION AT THE FERMI 2 FACILITY

This refers to the inspection conducted by Mr. G. Pirtle of this office

between November 15-23, 1993. The inspection included a review of authorized  !

activities for your Fermi 2 facility. At the conclusion of the onsite

'

inspection, the findings were discussed with those members of your staff .

identified in the enclosed report.

Areas examined during the inspection are identified in the report. Within

these areas, the inspection consisted of selective examination of procedures

and representative records, and interviews with personnel.

Based on the results of this inspection, certain of your activities appeared .i

to be in violation of NRC requirements, as specified in the enclosed Notice of

~

Violation (Notice). The violation is of concern because corrective actions

implemented when the violation was initially identified by your staff were not

effective in preventing recurrence.-We are also concerned about the. lack of.

attention to detail in reference to documentation pertaining to security

compensatory measures. This deficiency was also noted during the previous

inspection of the security program (Section 2.g of Report Details).

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response. In your

response, you should document the specific actions taken and any additional

actions you plan to prevent recurrence. After reviewing your response to this i

Notice, including your proposed corrective actions and the results of future

inspections, the NRC will determine whether further NRC enforcement action is' l

necessary to ensure compliance with NRC regulatory requirements. 1

The response directed by this letter and the accompanying Notice are not

subject to the clearance procedures of the Office of Management and Budget as .;

required by the Paperwork Reduction Act of 1980, PL 96-511. i
