Dear Mr. Bonito:

This letter responds to your letter dated June 8,1998, regarding the U.S. Department of Energy (DOE) agreement that UNC should develop a plan to address the residual contamination at 71 Shelton Avenue, formerly identified as Buildings 3H and SH, for activities previously authorized by NRC License No. SNM-386, last held by United Nuclear Corporation.

As detailed in our NRC Inspection Report No. 070-00371/96-001, dated July 26,1996, and

again in our letter to you dated April 16,1998, we requested that you provide to the NRC a plan ,

to further charactenze and ultimately remediate, if necessary, the areas with enriched uranium . '

Ll

! above 30 picocuries/ gram of soil or sediments. By your June 8,1998 letter, you indicated that you will proceed with site characterization using NUREG/CR-5849 es guidance, and should any L remediation be necessary, that UNC requests to use the Option 1 criteria delineated in the j NRC's Branch Technical Position for " Disposal or Onsite Storage of Thorium or Uranium t

Wasten from Past Operations," dated October 23,1981. We are in agreement that, at this particu;.r site, you may use a concentration of 30 pCi/g as an acceptable release enterion for enriched uranium, and that NUREG/CR-5849 provides acceptable guidance for demonstrating that this criterion will be met.

E Based on our recent discussions, we understand that additional information regarding a plan will L be submitted within a few weeks. We appreciate your cooperation to resolve this matter.

l l Sincerely, i
