SUBJECT: NRC INSPECTION REPORT NOS. 50-338/96-12 AND 50-339/96-12

Dear Mr. O'Hanlon:

Thank you for your response of February 5,1997, to our Notice of Violation issued on January 6,1997, concerning activities conducted at your North Anna facility. We have evaluated your response and found that it meets the requirements of 10 CFR 2.201. We will examine the implementation of your corrective action associated with Violations A and C during future inspections.

With regard to Violation B you requested that the characterization of the Violation be changed from cited to non-cited. This request is based on the fact that a Virginia Electric and Power Company (VEPCO) vendor surveillance representative identified the problem. The decision to issue a Notice of Violation was dictated by the requirements stated in NUREG-1600, General Statement of Policy and Procedures

for NRC Enforcement Actions. A Notice of Violation was issued because the

corrective actions for the deficiency were incomplete. Consequently, the requirements for a Non-cited Violation were not met. The corrective action did not address the weakness in your program for reviewing vendor documents as

,

highlighted by the circumstances of the bolt problem.

'

In the circumstances of the bolt problem, the vendor submittals did contain information that would have allowed an engineer to identify the problem before

~

installation of the non-conforming equipment. Namely, the fact that A307 bolt material is not suitable for pumps and there was a discrepancy between the seismic analysis report and the bill-of-material. The extent to which vendor submittals need be reviewed is a matter of judgement on the part of the responsible engineer.
