NRC INSPECTION REPORT NOS. 50-338/98-05 AND 50-339/98-05

NOTICE OF VIOLATION AND EXERCISE OF ENFORCEMENT DISCRETION

Dear Mr. O'Hanlon:

An NRC inspection was conducted July 13 - 31,1998, at your North Anna Power Station and an

in-office inspection of supplemental information was conducted September 21 - 25,1998. This

was a Safety System Engineering inspection (SSEI) The primary objective of this SSEl was to

assess the adequacy of calculations, analyses, and other engineering activities used to support

auxiliary feedwater system operability and reliability.

The inspection found the system to be operational overail. Based on the results of this

inspection, three violations were identified. We are concerned that for Violation B your staff

failed to implement adequate corrective actions to resolve corrosion of the AFW tunnel pipe

supports which had been initially identified in September 1996. We are also concerned about

Violations A and C which occurred as a result of inaccurate as-built drawings for safety related

piping systems. The violations appear to contradict your August 1,1979, response to IE Bulletin 79-14, Seismic Analysis for As-Built Safety-Related Piping Systems, in which you stated that

your rigid construction quality control program assured conformance of as-built piping systems

to design requirements. Although NRC expressed concerns regarding the scope of corrective

action, as of September 25,1998, your planned corrective actions did not appear adequate to

determine the extent of as-built drawing inaccuracies. The NRC again discussed, by telephone

conference on October 22,1998, our concerns regarding the adequacy of your planned

corrective actions. Based upon information you provided on October 28,1998, your currently

planned corrective actions do not appear to contain a statistically valid sample size to

adequately determine the extent of condition of as-built construction errors or drawing

inaccuracies for pipe supports. Such a review is needed because of the number of NRC

identified issues and the potential safety impact of unknown discrepancies. Your response to

Violation A should address your program to verify the adequacy of the as-built construction of

safety-related piping systems.

Although, the results of the inspection showed the overall quality of calculations was adequate to ,

support system operability, continued improvement in attention to detail is necessary to address

regarding the excessive length of time your staff required to determine operability of the Unit 1

AFW piping system after a multiple pipe support hanger was discovered to be missing on

June 16,1998. The final design analysis regarding the missing support was not completed until

j

July 29,1998, at which time you concluded that the missing AFW piping system support

degraded but did not effect the operability of the AFW system. In you response to this letter you

should address additional plans to strengthen and expedite performance of operability

{

evaluations.

The NRC has concluded that information regarding the reasons for Violations B and C, and the

corrective actions taken and planned to correct the violations, and to prevent recurrence, are

{

addressed on the docket in the enclosed inspection report. Therefore you are not required to

submit a response to this letter for Violations B and C unless the description therein does not

i

accurately reflect your corrective actions or your position regarding these violations. However,

if you choose to provide additional information, you should follow the instructions in the enclosed

notice.

The violations are cited in the Enclosed Notice of Violation and the circumstances surrounding

the violations are desenbed in detail in the enclosed report. Please note that for Violation A, you

are required to respond to this letter and should follow the instructions specified in the enclosed

Notice when preparing your response. The NRC will use your response, in part, to determine

whether further NRC enforcement action is necessary to ensure compliance with NRC

regulatory requirements.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter and its

enclosures will be placed in the NRC Public Document Room.
