In the Matter of Application of Texas Utilities Generating Company, et al . for An Operating License for Comanche Peak Steam Electric Station Units #1 and #2 (CPSES)

Docket Nos. 50-445 and 50-446 Correction of Wording in CASE's 10/13/83 (1) Motion to Add a New Contention, (2) Motion for Discovery, and (3) Offer of Proof During the October 1983 hearings, I mentioned to the Board Chairman and all parties that there was one portion of subject pleading where the wording needed to be changed slightly.

On page 54, item (2), please change the first line to read:

(2) Accept CASE's pleading and Offer of Proof in lieu of (or as part of) an answer to Our intention was that we believe we have already met the burden of proof that this is a valid contention which should be litigated (in which case we are asking that the Board accept our pleading and offer of proof in lieu of an answer . . .); if the Board disagrees that we have already established that this is a valid contention, we are asking that the Board accept our pleading and offer of proof as part of an answer . . .

We advised Applicants' Bill Horin and NRC Staff's Stuart Treby of this change by phone on 11/1/83, so that they would be aware of it when making their responses to CASE's Motions.
