4 Furthermore, NUMARC's request that the Commission usurp the I

ASLB and deny the CFUR petition reveals a disdain for the administrative and adjudicatory process and should be disregarded by the Commission.

Limiting a petitioner's right to intervene should not become a method for resolving issues in a licensing proceeding.

The potential for delay due to the ASLB's review of the CFUR petition is easily outweighed by the attendant increase in safety which may be accrued as well as the reassurance that the public's role in the licensing process is maintained.

If the Commission were to follow NUMARC's suggestion, the result would undermino public confidence as well as the NRC's credibility, d

In conclusion, the Nuclear Information and Resource Service urges the Commission to disregard the inappropriate suggestions of NUMARC and to allow the administrative process to run its course. We take no position on the merits of CFUR's contentions.

If the CTUR contentions fail on the mcrits, then the licensing process will not be unduly delayed and the NRC's credibility will not be undermined.

If, on the other hand, CTUR's contentions have merit, the resolution of these contentions will result in a safer plant.

The Commission will have fulfilled its statutory duty to ensure the public health and safety and whether UUKARC realizes it or not, industry and the public will both benefit.
