MINUTES OF INTERNAL MEETING OF THE DAVIS-BESSE OVERSIGHT PANEL The implementation of the IMC 0350 process for the Davis-Besse Nuclear Power Station was announced on April 29, 2002. An internal panel meeting was held on February 19, 2004. Attached for your information are the minutes from the Internal meeting of the Davis-Besse Oversight Panel, and the RAM Closure Forms.

MEETING MINUTES: Internal IMC 0350 Oversight Panel Meeting Davis-Besse Nuclear Power Station DATE: February 19, 2004 TIME: 12:30 p.m. Central ATTENDEES:

1. Arprove Today's Aaenda The Panel approved the agenda, but modified the order of presentations. THE APPROVED AGENDA REFLECTS THE ORDER LISTED IN THESE MINUTES.
2. Discuss Plant Status and Inspector Insights and Emergent Issues List S. Thomas led a discussion of Plant Status and inspector insights and emergent issues.

The plant is in Mode 3 maintaining Normal Operating Pressure/Normal Operating Temperature. (NOP/NOT - 5320F/2155 psig). The licensee expects to maintain the plant in these conditions until restart. The licensee removed from service for maintenance the 345 kV Bayshore offsite power supply source. The licensee is following its Technical Specifications.

3. Discuss New/Potential Licensing Issues J. Hopkins led a discussion of new/potential licensing issues. The licensee submitted to NRR an exemption request dated February 13, 2004, regarding boric acid precipitation control methodology.
4. Discuss Allegations: 1) New: 2) Determine If Required to Be Resolved Prior to Restart:

and 3) Reauested Extensions D. Passehl led a discussion of the status of allegations. D. Passehl discussed the one allegation needing to be resolved for restart. The closure memorandum was sent to EICS today. Separately, the Panel plans to discuss at tomorrow's meeting whether another allegation pertaining to the service water system was an allegation that needed to resolved prior to restart. Also, the Panel plans to present at an Allegation Review Board a February 14, 2004 letter. G. Grant has a copy of the letter for other non-allegation concerns discussed in the letter.

5. Discuss Communication Status J. Stang discussed a draft communication team memorandum which will document the dispositioning of various communications in accordance with the 'Davis-Besse Nuclear Power Station, Inspection Manual Chapter (IMC) 0350 Oversight Panel Communication Plan," and per the Davis-Besse IMC 0350 Panel Process Plan Item B.4.3.e. The Panel determined that open correspondence (i.e., correspondence that has not been responded to) will be discussed at tomorrow's Panel meeting so that the Panel can reach a decision on the acceptability of leaving some communication items open at restart.
6. Discuss RAM Closure Forms The Panel discussed several RAM Items recommended for closure. THE RESTART ACTION MATRIX ITEMS THAT THE PANEL APPROVED FOR CLOSURE ARE ATTACHED TO THESE MINUTES.
7. Discuss Restart Checklist Item 2.e Closure A. Mendiola discussed closure of Restart Checklist Item 2.e, 'High Pressure Injection Pump Intemal Clearance/Debris Resolution.' THE PANEL APPROVED CLOSURE OF RESTART CHECKLIST ITEM 2.e, BASED ON THE PANEL'S CLOSURE OF RAM ITEM URI-24 ON FEBRUARY 18, 204 AND THE HIGH PRESSURE INJECTION PUMP TIA NO. 2003-04 RESPONSE. CLOSURE WILL BE DOCUMENTED INTHE NRR INSPECTION RESULTS MEMORANDUM REFERENCING THE HIGH PRESSURE INJECTION PUMP TIA NO. 2003-04 RESULTS.
8. Discuss Restart Checklist Item 4.b G. Wright presented a draft Inspection results memorandum on Restart Checklist Item 4.b, 'Effectiveness of Corrective Actions.' The Panel provided comments to G. Wright for incorporation Into the inspection results memorandum.
9. Discuss Restart Checklist Item 5b D. Passehl presented a draft briefing paper summarizing the basis for closure of Restart Checklist Item 5.b, 'Systems Readiness for Restart.' The Panel provided comments to D. Passehl for Incorporation into the briefing paper.
10. Discuss Draft Restart Recommendation Memorandum to Regional Administrator J. Grobe led a discussion on the draft restart recommendation memorandum to the Regional Administrator. The Panel provided comments to J. Grobe for incorporation into the memorandum.
11. Discuss Draft Inspection Schedule Letter D. Passehl led a discussion on the draft inspection schedule letter. The Panel provided comments to D. Passehl for Incorporation into the letter.
12. Discuss Draft Restart Authorization Letter from Regional Administrator J. Grobe led a discussion on the draft restart authorization letter from the Regional Administrator. The Panel provided comments to J. Grobe for incorporation into the letter.
13. Discuss the 'Hot Lists of Actions Reauired to Support Panel Restart Decision C. Upa led a discussion of the *Hot Ustu of actions required to support panel restart decision.
14. Discuss/Uggate Milestones and Commitments The Panel reviewed and discussed upcoming milestones and commitments.

February 19, 2004 RAM Item No. - C-37 Closed: Y Description of Issue - Reauests for Issues: Are there any outstanding NRC staff questions concerning the Davis-Besse steam generator tube Inspection completed March 9, 2002, specifically with regard to the Information provided by the licensee dated November 3, 2003.

Descriptlon of Resolution - In accordance with Technical Specification (TS) 4.4.5.5.a, the licensee submitted the 2002 steam generator tube inspection results concerning the number of tubes plugged and repaired by letter dated March 22, 2002. Additionally, in accordance with TSs 4.4.5.5.b and 6.9.1.5.b, the licensee submitted more detailed Inspection results by letter dated March 31, 2003. The NRC staff reviewed the Inspection results and requested additional Information from the licensee. The staff questions were placed on the docket by letter dated September 23, 2003, and the licensee responded to the questions by letter dated November 3, 2003.

Based on Its review of the Information provided on November 3,2003, the staff developed additional questions which were provided to the licensee and placed on the docket by letter dated December 11, 2003. The licensee responded to those questions by letters dated December 17, 2003, and January 7, 2004. The NRC staff has reviewed the submittals and determined that the licensee has adequately responded to the staff's questions. This item Is closed.

RAM Item No. - C-38 Closed: Y Description of Issue - Requests for Issues: Resolve TIA on Fire Protection Issues Description of Resolution -

By memorandum dated December 15, 2003, the Panel requested technical assistance from the Office of Nuclear Reactor Regulation (NRR) regarding procedural allowance permitting reactor coolant level to go to the top of active fuel under certain post-fire safe shutdown scenarios at the Davis-Besse Nuclear Power Station, Unit 1.

The NRR staff has concluded that Davis-Besse Abnormal Procedure DB-OP-02519, Serious Control Room Fire," continues to provide reasonable assurance that, for anticipated fires In the control room or cable spreading room, the reactor can be safely shut down.

The detailed NRR staff determination is provided in a February 6, 2004, memorandum from E.

Leeds to J. Grobe transmitting the response to TIA 2003-006.

Based on the above, the concern regarding procedural allowance permitting reactor coolant level to go to the top of active fuel under certain post-fire safe shutdown scenarios at the Davis-Besse is resolved.

RAM Item No. - C-42 Closed: Y Descriptlon of Issue - Commenter at Restart Meeting on 2/12/04 Asked What Had Happened to Thermo-lag Orders of May and June 1998 for Davis-Besse. Were the Actions Completed?

DescriptIon of Resolution - Jon Hopkins researched this issue and found that there was one Confirmatory Order issued to Davis-Besse on Thermo-Lag dated June 22, 1998.

On May 4, 1998, NRR sent the draft Confirmatory Order to the licensee asking them to sign for consent to the Order. Following some negotiation of the Order language, consent was signed on June 11, 1998 and Order was issued June 22, 1998. In summary, the Order said complete Thermo-Lag corrective actions by December 31, 1998.

By letter dated January 25, 1999, the licensee provided written confirmation of a telephone call to the NRC on December 23, 1998, that modifications for Thermo-Lag were completed on December 22, 1998.

Based on discussions with the licensee, they do not take credit for any Thermo-Lag that is remaining in the plant.
