MINUTES OF INTERNAL MEETING OF THE DAVIS-BESSE OVERSIGHT PANEL The implementation of the IMC 0350 process for the Davis-Besse Nuclear Power Station was announced on April 29, 2002. An internal panel meeting was held on February 3, 2004 Attached for your information are the minutes from the internal meeting of the Davis-Besse Oversight Panel, and the Open Action Items List.

Discuss/Approve Todays Agenda The Panel approved the agenda, but modified the order of presentations. THE APPROVED AGENDA REFLECTS THE ORDER LISTED IN THESE MINUTES.

Discuss Inspection Results for RAM Item URI-38, Thermal Overpressure Protection of Service Water Components M. Holmberg briefed the Panel on the inspection results for RAM Item URI-38, Thermal Overpressure Protection of Service Water Components. The inspectors did not identify any system normal or emergency operating configurations or lineups that would result in isolating the containment air coolers, emergency diesel generator jacket water coolers, and decay heat removal system coolers from overpressure protection devices, without considering these components and associated piping systems inoperable. Further, no deviations from applicable Code requirements were identified with respect to location of relief protection devices for these components. The inspection results will be documented in Inspection Report 50-346/04-02.

Discuss Plant Status and Inspector Insights and Emergent Issues List S. Thomas briefed the Panel on plant status and inspector insights and emergent issues. The Panel held a detailed discussion on an electrical issue. On February 2, 2004, the licensee discovered a leak on the Startup Transformer (X01) A bushing, and entered Technical Specification action statement 3.8.1.1.a. The licensee was evaluating repair options. These include repair the existing bushing or replacement of the bushing. In parallel, the licensee is evaluating whether back-feeding through the station auxiliary transformer can be substituted as a qualified offsite circuit. The current schedule estimate for replacement of the bushing is approximately 4 days.

Also, the plant successfully exited the 72-hour Limiting Condition for Operation for Auxiliary Feedwater (AFW) Pump 1, after replacing the turbine governor and satisfactorily completing response time testing. The licensee has scheduled AFW Pump 2 quarterly performance testing and response time testing for February 3, 2004.

Discuss New/Potential Licensing Issues J. Hopkins led a discussion of new/potential licensing issues. Jon briefed the Panel on a restart issue involving a one-time extension of the Technical Specification 24-month fixed surveillance interval for Steam Generator inspection. The current interval expires on March 8, 2004. The licensee submitted License Amendment Request 03-0019, dated December 16, 2003. NRR subsequently submitted a Request for Additional Information and a response has been received by the licensee. NRR is targeting a response to License Amendment Request 03-0019 during the next week or so.

Jon also discussed a non-restart issue involving emergency diesel generator frequency and voltage startup response. The licensee is planning to revise its Updated Safety Analysis Report to reflect as-is transient analysis regarding frequency and voltage and submit a License Amendment Request.

Jon stated that a January 30, 2004, letter was issued to FirstEnergy Nuclear Operating Company (FENOC) regarding Davis-Besse reactor pressure vessel head sample pieces from the old reactor head. The NRC was interested in additional testing, including destructive testing, being performed on three sample pieces from the old Davis-Besse reactor pressure vessel head. The NRC intends to contract for the additional testing.

Jon also mentioned that the Draft Directors Decision on a 10 CFR 2.206 Petition dated August 25, 2003 from Greenpeace and the Nuclear Information and Resource Service and the Union of Concerned Scientists, is being provided for senior NRC management review.

Discuss Allegations D. Passehl stated that there are no new allegations received that must be resolved prior to restart. There remains one allegation required to be resolved prior to restart.

Reactor Oversight Program Sample Status S. Thomas led a discussion of the Reactor Oversight Program (ROP) sample status for the 4th quarter of 2003. The minimum sample requirements for each inspection module were met with the exception of performance indicator verification. In this case, Safety System Functional Failures, and Safety System Unavailability for Emergency AC Power and Decay Heat Removal were verified. All other performance indicators normally assessed by the resident staff did not provide meaningful information.

Discuss Format/Content of Restart Decision Transmittal Memo from Jim Caldwell to Licensee D. Passehl led a discussion of the format/content of restart decision transmittal memo from Jim Caldwell to the licensee. An outline of the letter was distributed to Panel members for comment.

9.

Discuss Monthly Input for Report to Congress

D. Passehl led a discussion of the monthly input for the January 2004 report to Congress. Panel members provided comments which will be incorporated into the final report.

10.

Discuss End of Cycle Report D. Passehl led a discussion of the 2003 End-of-Cycle Report. Panel members provided comments which will be incorporated into the final report.

11.

Discuss Documentation of NRR Review of Licensees Integrated Readiness for Restart Report/Supplemental Update to the Integrated Readiness for Restart Report J. Hopkins led a discussion of the proposed NRC evaluation criteria for review of the licensees Integrated Readiness for Restart Report/Supplemental update.

12.

Discuss Action Items The Panel reviewed the open Action Items. Panel members were reassigned to some of the Action Items. There were no new actions items opened and one action item was closed.

The restart Q & As have been received and reviewed by the Region and package provided to the RA. The Panel decided that this item is closed.

Discuss/Update Milestones and Commitments The Panel reviewed and discussed upcoming milestones and commitments.
