MINUTES OF INTERNAL MEETING OF THE DAVIS-BESSE OVERSIGHT PANEL The implementation of the IMC 0350 process for the Davis-Besse Nuclear Power Station was announced on April 29, 2002. An internal panel meeting was held on September 9, 2004.

Attached for your information are the revised minutes from the internal meeting of the Davis-Besse Oversight Panel and the Open Action Items List. The minutes were revised to modify Agenda Item 2.

1. Discuss/Approve Todays Agenda The Panel approved the agenda. THE APPROVED AGENDA REFLECTS THE ORDER LISTED IN THESE MINUTES.
2. Discuss Plant Status and Inspector Insights and Emergent Issues List J. Rutkowski discussed the current plant status. The plant was in Mode 1 at 100 percent power. Maintenance on the train 1 emergency diesel generator placed the plant in a planned 7 day Technical Specification action statement. The maintenance was scheduled to last 55 hours6.365741e-4 days <br />0.0153 hours <br />9.093915e-5 weeks <br />2.09275e-5 months <br />. Also, Train 1 of Control Room Ventilation is available but not operable. This is due to maintenance, which has temporarily eliminated the water-cooled mode for CR Ventilation, but the air-cooled mode remains available.

J. Caldwell and S Reynolds visited the site yesterday. Several key messages were discussed with the licensee.

1. The backlog reduction is not occurring as rapidly as the NRC would have expected, based on previous discussions with the licensee. M Bezilla reported that there are 15,000 open items with a decrease of about 100 per week.
2. Performance improvement from RATI 1 (December 2003) to RATI 2 (March 2004) occurred, but the licensee appears to have reached a plateau in performance.
3. The licensee can technically pass an Emergency Preparedness exercise yet still fail, if public confidence is not assured.
4. Davis-Besse is under world-wide scrutiny and problems at Davis-Besse could impact the entire industry.

In addition to these key messages, J Caldwell discussed the upcoming changes to 0350 Panel staffing with Lew Myers and Jere Witt.

J. Rutkowski expressed the Resident Inspectors observations regarding plant performance. The licensee stated that they were satisfied with the backlog reduction when asked by the NRC. However, in their internal meetings licensee managers gave the impression that they are not completely satisfied with the backlog reduction. They have several I&C technicians contracted to assist in backlog reduction.

The Panel decided it would be a good idea to discuss what resource constraints the reorganization may have regarding backlog reduction. J. Grobe suggested the NRC be prepared to discuss its observations during the next public meeting. The Panel determined that further NRC monitoring of licensee efforts to reduce backlogs is warranted.

Once key messages for the public meeting are developed Jere Witt should be notified.

3. Discuss Results of Recent Inspections and Inspection Plans C Lipa led a discussion about recent inspections and inspection plans. A copy of the Corrective Action Program Commitment Inspection Plan, revised by D Passehl, was included with the Panel documents. J Grobe and other Panel members gave C Lipa suggested revisions. J Grobe suggested the Panel determine if commitment inspections that were reviewed for effectiveness need to be revisited before being closed. This action was approved by the Panel.
4. Update for Panel on DRS activities J. Lara led a discussion of DRS activities.

J. Lara led discussion of the White finding at Surry for postulated fire scenario. This information was brought to the panels attention given that it appears to be similar to the Appendix R compliance issue at Davis-Besse had been reviewed in detail and the issuance of the Surry finding could result in that public questions as to the apparent discrepancy in how the agency evaluated the similar issue at two different plants. The panel discussed this issue and J. Hopkins will investigate the Surry finding for similarities to Davis-Besse Appendix R issues and report back to the panel.

5. Discuss Commitments in Operational Improvement Plan C Lipa will take care of the action item associated with this topic and inform the licensee that the Panel considers all the actions and indicators in the Plan to be commitments that should be discussed with NRC before any changes are made by the licensee.
6. Discuss New Allegations Not discussed in meeting.
7. Discuss Lessons Learned Update This topic was discussed briefly in that C. Lipa sent out a draft to all panel members and requested a response to get into final next week.
8. Discuss New/Potential Licensing Issues

J Hopkins reported that the Green Ticket 763 response is in the final approval phase and will be closed in the next 2 weeks. It was reported that NRR is again working on an Information Notice regarding TSP.

9. Discuss Communications Status A Mendiola discussed the status of the Communications Plan. A draft of Revision 3 to the Restart Communications Plan is being reviewed. A Mendiola has additional comments for C Lipa and will discuss them at a later time. J Grobe suggested a cover memo noting that the revision implements only minor changes, which were discussed at the 9/2/04 Panel meeting. He also suggested that C Lipa send a list of open DRS issues to allow the Panel to keep track of them and follow up as necessary.

Green ticket 551 was closed due to the decision to handle the ANS PI letter as an allegation. An ARB was held on 9/7/04 on this allegation and it was determined that, despite the alleger going public, the NRC would not place documents regarding this allegation in the PDR.

10. Discuss Action Items Action Item 251: The Panel requested operability evaluation 03-0032, Rev 2 ( or latest) regarding service water flow rates to heat exchangers, be added to the scope of the Service Water TI. Once this is done this Action Item will be closed.

Action Item 253: C Lipa continues to work on the Action Item. She has administrative help coming on 9/10/04 to assist with ADAMS.

Action Item 265: W Outlaw continues to work on this idea and the Panel decided to keep the Action Item open in the event it can be completed in the future.

Action Item 266: The Panel was instructed to review the document Christine sent out.

Action Item 267: Will be addressed at a later date.

Action Item 269: J Lara will take care of this Action Item while he is on site during the week of 9/13 - 9/17. He will discuss this with the licensee on 9/16/04.

Action Item 270: The Panel decided to change the due date to 10/29/04.

Action Item 271: Due date was previously changed.

Action Item 272: This task was completed 9/10. C Lipa discussed with R.

Schrauder on 9/10. An overall assessment of performance since restart was added to the Action Item discussion.

Action Item 274: This will be added to the PI&R inspection. Once the plan is brought to panel, the action item can be closed.

Action Item 278: M Holmberg developed a draft inspection scope for Panel discussion purposes. The TI on the pressurizer will be included.

A baseline In-Service Inspection is not actually required during the mid-cycle outage, but M. Holmberg will cover inspections that the panel determines to be necessary, including steam generator inspections and Order related bare metal visual inspections of the upper and lower head. A more detailed inspection plan will be produced before the end of CY 2004.
