MINUTES OF INTERNAL MEETING OF THE DAVIS-BESSE OVERSIGHT PANEL The implementation of the IMC 0350 process for the Davis-Besse Nuclear Power Station was announced on April 29, 2002. An internal panel meeting was held on January 24, 2005. Attached for your information are the revised minutes from the internal meeting of the Davis-Besse Oversight Panel and the Open Action Items List. The minutes were revised to modify Agenda Item 5.

Davis-Besse Nuclear Power Station DATE: January 24, 2005 TIME: 11:00 a.m. CST ATTENDEES:

1. Discuss/Approve Todays Agenda The Panel approved the agenda. THE APPROVED AGENDA REFLECTS THE ORDER LISTED IN THESE MINUTES.
2. Discuss Results of Problem Identification and Resolution (PI&R) Inspection Report D. Passehl discussed the PI&R Inspection. The report is currently in the review chain.

The team determined that the licensee was appropriately writing condition reports; that the trending program was still not fully effective; that the prioritization program was acceptable with appropriate due dates for completion of actions; and that for the most part corrective actions were effective. However, the team did identify two Green Non-Cited Violations associated with two examples where condition reports had not been written as required and one example where an issue was not appropriately resolved.

Regarding the teams review of the Independent Assessment of the Corrective Action program, the team concluded that the independent assessment was adequate and met the Order. The panel also discussed the need to replace Mr. Passehl as the lead inspector, due to his new assignment as Acting Chief of Projects Branch 3.

3. Discuss Plant Status and Emergent Issues S. Thomas discussed plant status. The plant was in Yellow risk due to reduced inventory with the steam generators isolated. The only emergent issue dealt with the cooling tower, which had iced up during the shutdown for the mid-cycle outage. Of note, the Union and FENOC Management have reached a tentative agreement, which is scheduled to go to the membership for a vote by the end of the month.
4. Discuss Process Plan The panel noted that there were no significant changes to the plan since the last panel meeting.
5. Discuss Pending Enforcement Cases C. Lipa informed the Panel that the communication plan was in the works for the violations that were about to be issued in the cafeteria workers cases. C. Lipa also updated the panel on the upcoming Enforcement Panel to resolve the 50.9 violation concerning the 1997 LER. l
6. Discuss Need for Broad Distribution of Bi-Weekly Status Reports The panel decided to keep this issue open pending discussion with headquarters offices regarding their need to continue receiving the updates.
7. Discuss Action Items Action Item 265: This item was closed.

Action Item 266: Closed - Memo issued on January 3, 2005.

Action Item 269: Remains open, the action has been reassigned to Gene Suh, and a draft letter to the licensee was in typing. Due date changed to 2/10/05 Action Item 282: Draft of proposed approach completed. Will be discussed at next panel meeting.

Action Item 283: Updated due date to 2/10/05.

The updated Action Item list is attached.

8. Discuss Impression of Haber Exit on Safety Culture S. Thomas discussed his impressions of the message conveyed by Dr. Haber to the licensees staff on Safety Culture at the site. In a nutshell, there was little to no improvement in most areas, with a few areas backsliding. The panel noted that the licensee would be providing an action plan to address the conclusions of the assessment when the report was submitted, and that the report was due to be submitted on February 4, 2005.
9. Discuss New Allegations There was one new allegation regarding an incident among security guards. The concern had already been to an Allegation Review Board and the actions to determine if the allegation could be substantiated were underway.
10. Discuss New/Potential Licensing Issues There are two new licensing amendment requests - one to use the TORMIS code and the second regards placing SFAS into bypass during certain conditions.
11. Discuss Communications Status The panel noted that the final ASP results were to go out this week. The communication plan was under development. G. Suh to take the lead to status the communication plan.

This was not added as an Action Item. There were no changes to the communications matrix.

12. Discuss POAM The leads were reminded to keep the POAM updated. Also, the panel noted that leads had been assigned for the remaining areas of the POAM which had previously been designated as 0350 panel.
13. Discuss Updates From Inspection Leads There were no updates provided other than the Corrective Action update discussed under item 2 above.
14. Discuss Input for Weekly Branch Chief Call with Licensee The panel identified the need to discuss the AARM meeting, the next public meeting, and a reminder for the licensee to submit a post-outage letter to include their assessment of how the outage went.
15. Discuss Deletion of Lochbaum et al from Standard Davis-Besse Distribution List The panel discussed whether or not documents that were being placed in ADAMS would be available to these individuals. The decision was for NRR to first determine what is available in ADAMS, and then if we further decided to delete them from standard distribution, NRR would write a letter to them stating that they would be taken off of the distribution list prior to that occurring. This was assigned as Action Item 285.
16. Going to Quarterly Inspection Report Frequency The panel decided that as long as Davis-Besse was an 0350 plant, we would continue to issue two reports per quarter rather than put them on the quarterly report frequency specified in the ROP program.
17. Discuss/Update Timeline and Milestones and Commitments 1/17 - 2/5: Mid-cycle outage (in progress) 1/31: FENOC Fleet Assessment in Akron, OH Feb. 10 Next Panel meeting tentatively scheduled for February 10 at 1:00 p.m.
