MINUTES OF INTERNAL MEETING OF THE DAVIS-BESSE OVERSIGHT PANEL The implementation of the IMC 0350 process for the Davis-Besse Nuclear Power Station was announced on April 29, 2002. An internal panel meeting was held on January 6, 2005. Attached for your information are the revised minutes from the internal meeting of the Davis-Besse Oversight Panel and the Open Action Items List. The minutes were revised to modify Agenda Item 4.

Internal IMC 0350 Oversight Panel Meeting Davis-Besse Nuclear Power Station DATE:

Discuss/Approve Todays Agenda The Panel approved the agenda. THE APPROVED AGENDA REFLECTS THE ORDER LISTED IN THESE MINUTES.

2.

Discuss Plant Status and Emergent Issues S. Thomas discussed plant status. The grid is in yellow risk due to weather conditions, with reports of some ice on the power lines. The licensee is not performing work which could affect generation at this time. CCW pump #3 maintenance is ongoing along with preparations for the upcoming outage.

S. Thomas has an exit meeting today with a potential Corrective Actions violation. In the exit he will let the licensee know the Panel has received and reviewed Revision 1 of the Operations Independent Assessment report. He will communicate that we find the report to be adequate.

The labor contract update is that negotiations between the Union and FENOC Management will take place on January 12.

Discuss Change in Chairmanship and Charter S. Reynolds is now the Chairman of the Panel.

Discuss Pending Enforcement Cases C. Lipa informed the Panel that a Choice Letter regarding the white finding and violation for siren failures is close to going public. Information about the cafeteria workers case is also close to going public.

l The Panel also discussed a potential 50.9 violation on a 1997 LER.

Discuss Updates From Inspection Leads J. Jacobson updated the Panel on his changes to the Post-Outage Action Matrix (POAM). They are reflected as follows.

C4.2:

J. Jacobson needs to get more information before this can be closed.

Also, this Commitment has been changed from an Effectiveness Review to a Reasonableness Review.

C5.2:

Items A and B are complete. Item C requires more review by J. Jacobson.

C6.1:

Item A is complete and items B and C will be ongoing for a while.

J. Jacobson will need some help with the electrical portion at a later date.

C6.2:

The 125VDC portion has been completed.

C6.3:

The licensee sent the NRC a letter outlining their plans for Calculations Improvement. We need to ensure the licensee continues to go forward with the improvements.

C6.6:

The licensee has done some extensive reviews and the plans for future reviews look good. This item is ready for closure.

Due to time constraints, J. Jacobson will continue his brief at the next Panel.

The Engineering Independent Assessment Report was received on December 6, 2004.

J. Jacobson will have comments included in IR 2004-16. The Assessment took place in October for 2 weeks with a total of 11 people. The team identified 3 areas for improvement:

Slow closure of some modifications Declining focus and rate of progress on Calc. Improvements Slippage of self-assessment schedule and mixed quality of self-assessments J. Jacobson feels that overall the Engineering program is acceptable but there are some improvements needed.

There was some discussion about how to handle the additional Commitments coming in as a result of the self-assessments. The Panel determined that it would be best to handle these in the same way PI&R samples are handled.

Discuss GL 95-07 Correction Submittal This item will be discussed at the next Panel.

7.

Discuss Ops Assessment Letter Revision Revision 1 was received and reviewed by the Panel. The Panel determined that Revision 1 adequately documented the assessment and meets the requirements of the Order.

8.

Discuss G. Wrights Impression of Haber Exit on Safety Culture This will be discussed at the next Panel.

9.

Discuss New Allegations There are no new allegations.

10.

Discuss New/Potential Licensing Issues There are no new licensing issues.

11.

Discuss Communications Status Some documents not in.pdf format are unavailable to the public on the Davis-Besse website. The Panel believes this is a result of limited public access to documents in ADAMS. ADAMS is expected to be available to the public by next week. The Panel decided to take no action unless the problem is not fixed within a couple weeks.

Discuss Process Plan The minutes from the November 10, 2004 Panel will be out soon. A public meeting will be scheduled for February. Changes to the Process Plan will be made by M. Phillips.

ACTION ITEM #284: W. Ruland should prepare for upcoming Congressional briefings.

The Panel decided more discussion is needed regarding updating and adding more details to the exit criteria. What is the best way to ensure the licensee is ready and meeting the criteria and how do we publicly release the plan?

14.

Discuss POAM The leads are keeping the POAM updated.

15.

Discuss Need to Issue Broad Distribution of Bi-Weekly Status Report This item will be discussed at the next Panel.

16.

Discuss Deletion of Lochbaum et al from Standard Davis-Besse Distribution List This item will be discussed at the next Panel.

17.

Discuss Input for Weekly Branch Chief Call with Licensee C. Lipa will discuss dates for the next public meeting.

The next Panel meeting will tentatively take place on January 24.
