MINUTES OF INTERNAL MEETING OF THE DAVIS-BESSE OVERSIGHT PANEL The implementation of the IMC 0350 process for the Davis-Besse Nuclear Power Station was announced on April 29, 2002. An internal panel meeting was held on March 4, 2004. Attached for your information are the minutes from the internal meeting of the Davis-Besse Oversight Panel, and the Open Action Items List.

MEETING MINUTES: Internal IMC 0350 Oversight Panel Meeting Davis-Besse Nuclear Power Station DATE: March 4, 2004 TIME: 12:30 p.m. Central ATTENDEES:

1. Discuss/Approve Todays Agenda The Panel approved the agenda, but modified the order of presentations. THE APPROVED AGENDA REFLECTS THE ORDER LISTED IN THESE MINUTES.
2. Plant Status and Inspector Insights and Emergent Issues List D. Passehl led a discussion of plant status and inspector insights and emergent issues.
3. Discuss NRC Staff Concerns J. Grobe led a discussion of a staff concern pertaining to Raychem Splices. The panel accepted this item for closure. The item will be documented in NRC Inspection Report 03-10 and to the public ADAMS package on staff concerns. THE CONCERN CLOSURE IS ATTACHED TO THESE MINUTES.
4. Recent FOIA Request A. Mendiola led a discussion of a recent FOIA request.
5. Status of CATI Report J. Grobe led a discussion of the status of the CATI report. The report should be ready to be issued soon. The report has one non-concurrence. The Panel is following Region III procedure on non-concurrences. C. Lipa and J. Lara are planning to ensure that the reason for the non-concurrence is understood and to re-confirm that there are no restart concerns from the individual. Given the non-concurrence, the Panel confirmed that the February 26, 2004 restart recommendation from the Panel does not change.
6. Inspection Results Forwarding Memo J. Grobe led a discussion of inspection results forwarding memo. The Panel provided comments for incorporation into the memo.
7. Restart Communication Plan W. Ruland led a discussion of the restart communication plan. The Panel determined that J. Strasma should be the owner of the restart communication plan and be cognizant of each step as it is completed. C. Lipa took action to contact J. Strasma on this issue.
8. February Input to Congress Report D. Passehl led a discussion of the draft report to Congress for February 2004.

D. Passehl will incorporate the Panels comments.

9. Records to Be Made Publically Available upon Restart (IMC 0350 Records Requirement)

D. Passehl led a discussion of records requirements discussed in IMC 0350. The Panel agreed on the list of records to be maintained or made public at restart. The Panel determined that the following records shall be tracked as an AITS item to be made public at the appropriate time in the future:

  • The basis for the licensees return to the ROP.
  • A letter to the licensee documenting termination of the IMC 0350 process.
  • A memorandum to NRR providing the lessons learned to be considered for incorporation in the next revision to IMC 0350.
10. Communication Status A. Mendiola led a discussion of the status of communications.
11. Discuss Action Items C. Lipa led a discussion of the action item list. The Panel dispositioned the following action items:

Item 255 (Closed) - Respond before restart to the 12/31/03 letter from Nuclear Information and Resource Service.

The response letter was issued on March 4, 2004.

Item 258 (Open) - Issue memo to J. Grobe, attaching city/county resolutions. Check if FEMA letters of 2/23/04 are in ADAMS (3/4/04).

March 4, 2004 Staff Restart Concern-14 Closed: Y Description of Issue - On 3/01/04, an NRC inspector raised a concern regarding the adequacy of licensees extent of condition review for Condition Report 02-005459, relating to replacement of containment air coolers and associated cables Raychem splices.

Description of Resolution - During CAC motor replacement, the licensee identified splitting of the motor cable insulation as documented in CR 02-05459. In 2002, the NRC examined this issue and concluded that the CAC cable had apparently been cut by a sharp instrument, rather than the result of an aging or contamination related mechanism as initially assumed by the licensee. The team noted that the licensee had not documented whether any extent-of-condition review was done to determine if the same contractors had performed other maintenance activities incorrectly. The CATI review of this issue concluded, based on review of the licensee's apparent and root cause investigations, that the licensee's contractor that performed this Raychem splice removal activity was trained and qualified.

However, the individual did not recall that he was trained on this activity and did not follow the Raychem installation procedure.

The licensee replaced the associated CAC cables which addressed the hardware issue. The team questioned the licensee at the end of the inspection if an extent of condition had been performed to determine if the individual or individuals who performed this activity had removed other Raychem splices on other safety related components.

The licensee staff responded to the NRC questions and provided information from the individual involved with the subject cable splices. The licensee informed the NRC inspector that the individual had not removed any other Raychem splices in the past and the subject work activity was limited to this individual only. Based on this information this concern is considered resolved for restart.

The failure to follow the maintenance procedure for removing Raychem' sleeves constituted a violation of 10 CFR Appendix B, Criterion V, which has minor significance.
