MINUTES OF INTERNAL MEETING OF THE DAVIS-BESSE OVERSIGHT PANEL The implementation of the IMC 0350 process for the Davis-Besse Nuclear Power Station was announced on April 29, 2002. An internal panel meeting was held on February 17, 2004. Attached for your information are the minutes from the internal meeting of the Davis-Besse Oversight Panel, the approved RAM Closure Forms, the Verification of Training Completion for Licensee Operators Regarding Davis-Besse Abnormal Procedure DB-OP-2519, Serious Control Room Fire, Revision 8" summary review document, and the Open Action Items List.

MEETING MINUTES: Internal IMC 0350 Oversight Panel Meeting Davis-Besse Nuclear Power Station DATE: February 17, 2004 TIME: 12:30 p.m. Central ATTENDEES:

1. Discuss/Approve Todays Agenda The Panel approved the agenda, but modified the order of presentations. THE APPROVED AGENDA REFLECTS THE ORDER LISTED IN THESE MINUTES.

2. Discuss Plant Status and Inspector Insights and Emergent Issues List S. Thomas led a discussion of plant status and inspector insights and emergent issues.

The plant is in Mode 3 at Normal Operating Pressure/Normal Operating Temperature (2155 psig/532OF). The licensee expects to maintain the plant in these conditions until restart, and continues to work through the 27 remaining restart restraints items. The X01 Startup Transformer has been returned to service.

S. Thomas also briefed the Panel that the resident staff is reviewing the licensees completed operability evaluations. The licensee expects to have 6 operability evaluations remaining open at restart.

3. Discuss RAM Closure R. Baker led a review of RAM closure items. To expedite closure of the remaining open RAM items, the Panel decided that the item owner should be present at the meeting to resolve questions that arise. THE RESTART ACTION MATRIX ITEMS THAT THE PANEL APPROVED FOR CLOSURE ARE ATTACHED TO THESE MINUTES.

4. Discuss Appendix R Required Operator Training S. Thomas presented a summary paper on the status of completing required operator training on the licensees Abnormal Procedure DB-OP-2519, Revision 8, necessary to remain in compliance with Section III.L of Appendix R. The Panel decided that this issue is adequately resolved to support to restart of the plant, and that Action Item 243 is Closed. THE

5. Discuss Review of Outstanding Licensee Pre-Restart Commitments

A. Mendiola led a review of the draft memorandum to J. Grobe from the NRC staff which documents the results of a review of all the licensees pre-restart commitments to the Oversight Panel. The Panel suggested that the memorandum should define the time frame covered and then the document should be put in final for concurrence.

6. Discuss Review of the HPI Pump Minimum Recirculation Flow Issue P. Lougheed and Z. Falevits briefed the Panel on the licensees response to the HPI Pump Minimum Recirculation Flow Issue and the closure status for RAM Item URI-24.

P. Lougheed took an action to revise the RAM Closure form, incorporating several clarification comments from todays discussion, and present the item for closure at the next Panel meeting.

7. Review Restart Checklist Item 7.a, Confirmatory Action Letter Completion for Closure C. Lipa led a discussion on closure criteria for Restart Checklist Item 7.a, Confirmatory Action Letter Completion. J. Hopkins presented the draft memorandum documenting a review of the licensees Integrated Readiness to Support Restart report and the Supplement to the Report. The licensee submitted the Revision 3 to the Operational Improvement Plan for Cycle 14 today and expects to submit the complete Supplement report by the end of the week. The Panel decided that once review of the Supplement report is complete, the memorandum will be issued and the CAL item will be considered complete. At that point, Restart Checklist Item 7.a may be approved for closure.

8. Review Restart Checklist Item 5.c, Operations Readiness for Restart for Closure D. Passehl presented the draft of the briefing paper summarizing the basis for closure of Restart Checklist Item 5.c, Operations Readiness for Restart. The Panel suggested several editorial comments. D. Passehl took action to incorporate these comments into the draft document and present the final draft for approval at the next Panel meeting.

9. Discuss Process for Dispositioning Comments/Letters Received at a Public Meeting J. Grobe led a discussion on the disposition process for comments and letters received at the 0350 oversight public meetings now that the public Restart Meeting is complete.

J. Strasma commented that the disposition process still adequately addresses comments and letters received, and that the policy for always responding to letters remains unchanged. J. Strasma is drafting a revised response from J. Caldwell which will reflect current events, and that the next group of responses will be held until after a restart decision is made. All letters recently received are being reviewed by the public affairs staff for any issues which could impact a restart decision, but to date, no new issues have been noted. The Panel concurred with this plan of action, with the understanding that all reviews will be complete prior to deliberations on a restart decision.

10. Discuss Recent Letter Related to Service Water System Restart Concerns C. Lipa led a discussion on review of a letter, dated February 13, 2004, involving two service water system allegations. The Panel decided that although no new allegations arise from this letter, the issues addressed need to be resolved prior to restart. The

actions required to resolve the issues are to verify that the issues are documented in the licensees Corrective Action Program and that the issues are properly prioritized for restart. The residents will verify these actions are complete and brief the Panel at a future Panel meeting.

11. Discuss Revised Hot List Actions Required to Support a Restart Decision C. Lipa led a discussion on the status of revised Hot list actions required to support deliberation on a restart decision. The Panel decided that a detailed review of the Panel Process Plan, Punchlist, and Open Action Items will be conducted to determine which items required completion prior to deliberation on a restart decision, and the specific items will be discussed at a Panel meeting later this week. D. Passehl and R. Baker took the action to update these reference documents and provide the Panel brief.

One new Action Item was added and one Action Item was closed.

12. Discuss Topics for Licensees Weekly Call C. Lipa took an action to contact the licensee (C. Price) and verify that there will not be a licensee call this week.

13. Discuss Possible Timeline for Required Restart Recommendation Briefs J. Grobe presented possible opportunities for conducting the restart recommendation brief to J. Caldwell, J. Dyer, and S. Collins. Based on availability, the best windows for the briefs will be Monday (2/23/04) afternoon and Tuesday (2/24/04) morning. The Panel concurred that Monday afternoon would be the best choice. J. Grobe took an action to get the briefing placed on the Regional Administrators calendar, and W.

Ruland will update the calendars for J. Dyer and S. Collins. The briefing for the Commissioners Technical Assistants is tentatively scheduled for Wednesday morning, 2/25/04.

14. Discuss Update Milestones and Commitments The Panel reviewed and discussed upcoming milestones and commitments.

15. Discuss Key Items Scheduled for the Next Panel Meetings C. Lipa led a discussion on the key items scheduled for Panel meetings the remainder of the week. The focus will remain on resolving items which would impact deliberations on a restart decision.

RAM Items Approved for Closure at Panel February 17, 2004 RAM Item No. - LER-23 Closed: Y Date of Letter - LER 50-346-2003-014; Steam Feedwater Rupture Controls System Re-Energizes in a Blocked Condition; dated December 16, 2003; Event Date October 17, 2003 Description of Issue - The licensee has a Steam Feedwater Rupture Control System (SFRCS) that is designed to isolate feedwater to a ruptured steam generator and to provide feedwater to the non-faulted generator. In October, 2003, during work on the SFRCS which required de-energizing and energizing various portions of the system, the licensee identified that upon re-powering of logic channels they sometimes re-energized with the logic, that indicated a ruptured generator, in a blocked state. If a steam line break were to occur on steam generator 2, followed by a loss of offsite power, and if the susceptible logic circuits re-energized in a blocked condition, the SFRCS would not isolate feedwater to steam generator 2.

Description of Resolution - The initial event was described in IR 50-346/2003-022. The licensee developed and implemented a design change (ECP 03-0569-00) to correct the SFRCS logic to prevent blocking upon restoration of power. This modification fixed the physical discrepancy. Review of this modification was documented in IR 50-346/2003-025. The regulatory aspects of the LER and event will be documented in IR 50-346/2004-006. Based on review of the referenced documents, the inspectors conclude that the licensee can consider the SFRCS system operable and that open corrective actions have been adequately scheduled for completion.

RAM Item No. - NCV-28 Closed: Y Description of Issue - As documented in Inspection Report 05000346/2003018, an NCV was issued for the failure of the licensee to address all significant causal factors related to the configuration control aspects associated with the installation of unqualified relay in the SFAS system.

Description of Resolution - The licensee failed to take effective corrective actions to fully address the cause of the condition, namely, addressing the configuration control aspect of how five unqualified relays remained installed in SFAS for an extended period of time without the applicable engineers knowledge. The inspectors determined that, although the corrective actions were not complete, that there are no open corrective actions which require closure prior to restart, and that the planned corrective actions would appropriately address the causes of the performance deficiency. The inspectors also reviewed the outstanding corrective action due dates and determined they were appropriate.

RAM Item No. - SUP-48 Closed: Y Description of Issue - Assessment of Performance in the Reactor Safety Strategic Performance Area:

Key Attribute - Configuration Control: Assess the effectiveness of corrective actions for deficiencies involving configuration control.

Description of Resolution - The restart readiness assessment team inspections assessed configuration control (i.e. valve lineups) as did the resident inspection staff during Mode changes in December 2003 and January 2004. The restart readiness assessment team inspections concluded that specific problem areas and issues observed during the first restart readiness assessment team inspection, which included configuration control issues, were acceptable.

The resident inspectors reviewed the licensees daily configuration risk assessments as part of their normal duties and concluded that equipment configurations had been properly listed in daily status sheets, that protected equipment had been identified and was being controlled where appropriate, and that significant aspects of plant risk were being communicated to the necessary personnel.

Verification of Training Completion for Licensee Operators Regarding Davis-Besse Abnormal Procedure DB-OP-2519, Serious Control Room Fire, Revision 8 By memorandum dated December 15, 2003, Region III requested technical assistance from the Office of Nuclear Reactor Regulation regarding procedural allowance permitting reactor coolant level to go to the top of active fuel under certain post-fire safe shutdown scenarios at the Davis-Besse Nuclear Power Station.

The NRR staff concluded that the Davis-Besse Abnormal Procedure DB-OP-02519, Serious Control Room Fire, continues to provide reasonable assurance that, for anticipated fires in the control room or cable spreading room, the reactor can be safely shut down. This conclusion is based on the margin of safety provided by the difference in time it takes operators to perform the required actions in the procedure and the time required for the reactor to reach a potentially unrecoverable situation following a control room or cable spreading room fire. In the unlikely event that a spuriously opened PORV required 45 minutes to close, the collapsed reactor coolant level would be above the top of active fuel.

This configuration assures that there is adequate reactor coolant surrounding the fuel to prevent cladding damage, in accordance with III.L of Appendix R. The staff recommended that Region III inspectors verified that operator were fully trained on Revision 8 to Abnormal Procedure DB-OP-02529.

The Davis-Besse resident staff verified that, as of February 16, 2004, approximately 86 percent of the on-shift licensed operators had completed the required training, and that the remaining 4 on-shift licensed operators were scheduled to complete the training by the end of the week.
