MINUTES OF INTERNAL MEETING OF THE DAVIS-BESSE OVERSIGHT PANEL The implementation of the IMC 0350 process for the Davis-Besse Nuclear Power Station was announced on April 29, 2002. An internal panel meeting was held on January 8, 2004. Attached for your information are the minutes from the internal meeting of the Davis-Besse Oversight Panel, the approved Management & Human Performance Followup Inspection Plan, the approved RAM Closure Forms, and the Open Action Items List.

1. Discuss/Approve Todays Agenda The Panel approved the agenda, but modified the order of presentations. THE APPROVED AGENDA REFLECTS THE ORDER LISTED IN THESE MINUTES.
2. Discuss Plant Status and Inspector Insights and Emergent Issues List S. Thomas led a discussion of plant status and inspector insights and emergent issues.

The licensee is preparing to conduct a plant cooldown to Mode 4. The cooldown is required by Technical Specification 3.7.1.2.a, due to a turbine casing steam leak identified on #1 Auxiliary Feedwater Pump low pressure turbine during the post maintenance testing of the governor. The licensee also plans to perform work on

  1. 2 Auxiliary Feedwater Pump to ensure that the same problem does not occur on that pump. Additional work items being scheduled following the cooldown include:
1) Repair of a small steam leak on a body-to-bonnet seal weld on valve RC1AB, the reactor coolant system loop 2 hot leg flow transmitter source valve.
2) Complete required testing on Steam/Feed Water Rupture Control System channel 2 steam generator differential pressure input. Testing was suspended due to leaking isolation valves on the 5-way valve manifold for the pressure switch and the licensee plans to replace the 5-way valve manifold.
3) Repair the motor coupling on Containment spray pump #2, which exhibited an abnormally high outboard bearing temperature while being used to recirculate water in the Borated Water Storage Tank. The cause was determined to be a misaligned coupling. Repairs are scheduled to be completed on 1/12/04. If the pump is not operable by 5:45 p.m. on 1/13/04, Technical Specification 3.6.2.1 would require return to Mode 5.

S. Thomas also provided an update on the issue of an inadvertent Technical Specification violation. On January 6, 2004, problems occurred during the surveillance testing of a flow measurement instrument in the feedwater system. The test required the instrument be taken out of service; the Technical Specification requires that the instrument be restored to service within 1 hour1.157407e-5 days <br />2.777778e-4 hours <br />1.653439e-6 weeks <br />3.805e-7 months <br /> or that the instrument be placed in a

tripped condition. Because of the testing problems, technicians were unable to complete the test, but did not restore the instrument to service within the required period. It was restored in about 2 hours2.314815e-5 days <br />5.555556e-4 hours <br />3.306878e-6 weeks <br />7.61e-7 months <br />. This situation was apparently the result of inadequate communications between the testing staff and the control room operators.

Because of this incident, the Chief Operating Officer of FirstEnergy Nuclear Operating Co. requested that the NRC defer the Followup Restart Readiness Assessment Team Inspection, previously planned to begin January 12. The licensee is conducting a root cause analysis of the evolution and will provide the results to the NRC when available.

3. Discuss and Receive Comments on the Format and Content of the Revised Daily Updates for Davis-Besse Status J. Grobe led a discussion on the process of providing a daily update Davis-Besse restart status to senior management. The daily status provided by the Senior Resident Inspector will be updated and sent out by 4:00 p.m. EST to the DB0350 distribution list, J. Caldwell, and G. Grant. R. Baker took the action to send out the daily updates.
4. Discuss Recent Licensee Actions Which Impact When the Restart Meeting Will Occur C. Lipa led a discussion on how recent licensee actions will impact the proposed date of the Public Restart Meeting. The Panel concurred that the next earliest date would be after the Followup RRATI and review of the licensees root cause analysis of recent operational performance deficiencies. The meeting could possibly be as early as January 29, but this is entirely dependent on the licensees actions to address performance issues.
5. Discuss Management & Human Performance Followup Inspection: Staffing/Strategy/

Logistics/Exit G. Wright led a discussion on the approach, staffing, and logistics for conducting the Followup Management and Human Performance Inspection. One key note of the discussion was the need to maintain a separation between the inspection objectives of the Followup RRATI and the Followup Management and Human Performance inspections.

6. Panel Review/Approve Management & Human Performance Followup Inspection Plan G. Wright led a review of the Followup Management and Human Performance Inspection Plan. The Panel provided minor editorial changes and approved the inspection plan. THE APPROVED INSPECTION PLAN IS ATTACHED TO THESE MINUTES.
7. Discuss Including the Operations Area Concerns in the Draft Confirmatory Order Again, the question of the need to include the operations area in the Confirmatory Order arose, especially in light of the recent licensees operational performance challenges.

The Panel decided to gather additional information concerning recent events in this area and to discuss this topic at the next Panel meeting on January 13.

8. Discuss Reasonableness of Licensees Success Path J. Grobe opened a discussion on whether or not the licensee has a reasonable approach to a success path for correcting the deficiencies observed in the operations area. The Panel concluded that a final determination will have to wait for the licensee to complete its root cause determination. Following a review of that report, the Panel will revisit this issue.
9. Discuss Revised Restart Recommendation Memo J. Grobe led a review of the revised Restart Recommendation Memorandum. Due to the extensive update of both the memo and the attachments, the Panel decided to review and provide final comments to M. Phillips. M. Phillips took the action to resolve the comments and present the final draft at a future Panel meeting.
10. Discuss New/Potential Licensing Issues J. Hopkins briefed the Panel on the status of the Steam Generator (SG) inspection license amendment request. The licensees responses to the March 2002 SG inspection RAI have been received and are being reviewed by the technical staff. Initial review indicates that all of the questions have been adequately resolved and the technical staff is moving forward with the license amendment request.
11. Discuss Communication Status J. Stang informed the Panel that the Communications Team Tracking Matrix is being updated with resolutions from yesterdays Communication Team meeting, and will be ready for Panel review at next weeks Panel meeting.
12. Discuss RAM Closure Items M. Phillips led a review of RAM closure items. THE RESTART ACTION MATRIX ITEMS THAT THE PANEL APPROVED FOR CLOSURE ARE ATTACHED TO THESE MINUTES.
13. Discuss Action Items C. Lipa led a review of the Open Action Items. The Panel decided that a new column would be added to the list to provide a due date for the assigned items, to help facilitate tracking of the issues, and due dates were established for the Action Items. R. Baker took the action to revise the Open Action Items list for the next Panel meeting.

One new Action Item was added to the list. THE UPDATED OPEN ACTION ITEMS LIST IS ATTACHED TO THESE MINUTES.

14. Discuss Punch List C. Lipa led a review of the Punchlist. R. Baker took the action to update the Punchlist with the Panels comments.
15. Discuss/Update Milestones and Commitments The Panel reviewed and discussed upcoming milestones and commitments.
16. Review Key Items Scheduled for Next Panel Meetings C. Lipa discussed key items scheduled for upcoming Panel meetings.

Follow Up Inspection:

The Follow Up Inspection of the Management and Human Performance Assessment is to independently verify the licensees assessment of the causal factors responsible for the decline in performance between the March and November SCWE surveys and to assess the corrective actions proposed to address the factors. The team proposes to use a modified Phase 3 to accomplish the task. The inspection will be accomplished by a special inspection consisting of NRC inspectors, specialists, and consultants noted below.

The Follow Up Inspection plan consists of a review of the method the licensee used to assess the survey findings, independent verification/validation of the data obtained by the licensee, assessment of the data reduction, and review and assessment of the corrective actions identified by the licensee.

The basic activity of the inspection will be interviews with both focus groups and individuals. We expect to conduct 6 focus groups and a 25% random sample of individual interviews from staff in operations, plant engineering, maintenance and quality assurance.

III Inspection Deliverables:

This special inspection is designed to provide the NRCs 0350 Panel (Panel) with an evaluation of (1) the processes the licensee used to assess changes in the results of the safety culture and safety conscious work environment (SCWE) survey (ECP survey) conducted in March and November 2003, (2) the corrective actions the licensee plans for improving their safety culture and SCWE, and (3) the monitoring activities the licensee plans to undertake associated with continued assessment of its safety culture and SCWE. The input from this inspection, when combined with other inputs, e.g.,System Health inspections, Program Review inspections, Containment Health inspections, and the Corrective Action Team Inspection, will allow the Panel to make an informed decision on the effectiveness of the licensees Management and Human Performance corrective actions. To that end, the following deliverables are expected from this special inspection.

A. Independent Assessment The inspection team will provide the 0350 Panel with an assessment of the input parameters, evaluation techniques, and methods to determine the root cause and to develop conclusions used by the licensees assessment team.

B. Assessment of Licensee Corrective Actions The inspection team will provide the 0350 Panel with an assessment of the actions the licensee plans to implement to improve the their safety culture and SCWE.

C. Future Monitoring Activities In light of the decline in survey results between March and November, the team will revisit the licensees proposed monitoring plans for 2004 to evaluate their appropriateness.

IV Inspection Details A. Independent Assessment, i.e., the assessment performed by the contractor.

1. Evaluate suitability of the following tools used by the independent assessment team, relative to the data from the November ECP survey:
a. interview questions
c. appropriateness of the focus group technique;
d. documents reviewed
e. sampling plan for all above 3
2. Evaluate implementation of the licensees safety culture evaluation techniques
a. how individuals were selected to participate as described in the process; and
b. the qualifications and independence of the assessment team
3. Evaluate the methodology used to develop results and conclusions from the data to determine:
a. if the methodology is appropriate, applicable, and comprehensive;
b. if the methodology was applied consistently; and
c. if the statistical techniques applied to sampling and to the results were appropriate.
4. Evaluate the results of the assessment and the data collected by the licensees evaluation team to determine:
a. if the results drawn from the assessment are consistent with the data collected;
b. how the results drawn from the assessment compare with data from the ECP survey
c. if the overall conclusions drawn from assessment are consistent with the data collected by the licensees evaluation team
d. If the results of the inspections teams efforts confirm the licensees results B. Review the licensees response to the findings from the ECP survey and the independent assessment to determine:
1. If planned actions are appropriate for resolving identified issues
2. If appropriate monitoring methods are in place to identify similar problems in the future
3. If appropriate criteria for qualifications of personnel who will conduct and evaluate the results of future periodic safety culture and SCWE assessments have been established;
4. If appropriate criteria for action based on the results of future periodic safety culture and SCWE assessments have been established V Methods A. Interviews
1. The inspection team will use a combination of individual and focus group application specific interviews to achieve a random sample of approximately 25% of target working groups for individual interviews, with 4

a control sample from one other work group. The focus groups will consist of from six to eight individuals randomly selected from each work group. These individuals would not be exempt from selection for individual interviews. The team will also be available for confidential interviews off-site for individuals who want that level of confidentiality.

2. The inspection team will review any written reports resulting from the licensees independent assessment
3. The inspection team will review condition reports and corrective actions resulting from the licensees independent inspection
4. The inspection team will review licensee documents and procedures that describe their implementation of corrective actions and continued monitoring of safety culture and SCWE VI Brief 0350 Oversight Panel on findings and conclusions from inspection.

RAM Items Approved for Closure at Panel January 8, 2004 RAM Item No. - C-35 Closed: Y Description of Issue - Extent of Condition Reviews for generic implications were inadequate as determined by a Perry review of D-B CRs.

Restart Checklist Item: N/A Description of Resolution - DRP BC followed up with the licensee to discuss the Perry root cause report that referred to a review of several DB and Perry CR extent of condition reviews.

The root cause report documented several problems at both Perry and Davis-Besse. The Davis-Besse staff reviewed the Perry Root Cause Report. In the Root Cause Report done by Perry, the licensee listed several preventive actions that were being taken to address the "generic implications" issue. Licensee staff stated that some of these actions were Corporate level actions. One of the actions was to incorporate the generic implications issue into the Apparent Cause Training the licensee had been giving at Davis-Besse. Also, the licensee will be clarifying the guidance/definition of "generic implications" on a pilot basis and then reevaluating the need to incorporate this into the Corrective Action Program. The NRCs review determined that this level of review by the Davis-Besse licensee and the corrective actions proposed were reasonable.

RAM Item No. - LER-22 Closed: Y Description of Issue - Trip of Reactor Protection System During Plant Cooldown. Davis-Besse Operations Procedure DB-OP-06903, Plant Shutdown and Cooldown, Revision 11 provided an option to cooldown the reactor coolant system with the Group 1 Safety Control Rods fully withdrawn.

Description of Resolution - The performance deficiency associated with this event is the control room staff did not adequately monitor and control reactor coolant system pressure which resulted in an unexpected reactor trip on shutdown bypass high pressure. The licensee implemented several actions to address the deficiencies associated with this issue. These actions included the following:

  • until completion of the initial analysis of the event, returned the plant to normal operating pressure and temperature with all control rods tripped;
  • implemented an operational stand down until the initial investigation of the event could be completed;
  • implemented their problem solving and decision process and developed a root cause analysis;
  • modified the cooldown procedure to reflect results from the initial investigation;
  • developed guidance for that cooldown that specified the pressure and temperature band specifically for each evolution until Mode 5 was attained;
  • for the cooldown to Mode 5 for each control room shift crew, conducted just in time simulator training that covered just the activities that would occur on that shift; and
  • chartered a team to review the collective significance of this trip and other recent events involving operations and to develop an operations improvement plan.

The licensee entered the event into its corrective action program as Condition Report 03-08374.

The inspectors reviewed the outstanding corrective actions and determined the proposed actions and due dates assigned to these actions were appropriate.
