MINUTES OF INTERNAL MEETING OF THE DAVIS-BESSE OVERSIGHT PANEL The implementation of the IMC 0350 process for the Davis-Besse Nuclear Power Station was announced on April 29, 2002. An internal panel meeting was held on January 15, 2004. Attached for your information are the minutes from the internal meeting of the Davis-Besse Oversight Panel, and the Open Action Items List.

Discuss/Approve Todays Agenda The Panel approved the agenda, but modified the order of presentations. THE APPROVED AGENDA REFLECTS THE ORDER LISTED IN THESE MINUTES.

Discuss Plant Status and Inspector Insights and Emergent Issues List S. Thomas led a discussion of plant status and inspector insights and emergent issues.

The plant is in Mode 4 (temperature less than 280 degrees F). The licensee has completed repair of the pump casing steam leak on #1 Auxiliary Feedwater pump.

Overspeed testing is scheduled for today, January 15. The licensee will also perform work on #2 Auxiliary Feedwater pump to preclude a similar leakage problem developing on that pump. Work on both pumps is scheduled to be completed on January 17, 2004.

Following completion of the auxiliary feedwater pump work, the licensee intends to return to Mode 3 and heatup to normal operating temperature and pressure. Plant management will resume its observation and assessment of plant operations before requesting that the NRC schedule the followup restart readiness inspection.

Repair and testing continues on a small steam leak on a body-to-bonnet seal weld on valve RC1AB, the reactor coolant system loop 2 hot leg flow transmitter source valve.

Discuss New/Potential Licensing Issues J. Hopkins briefed the Panel on the status of licensing issues. The technical NRR staff reviewing the Steam Generator (SG) inspection license amendment request is drafting an RAI to send to the licensee. If the request is not approved, the licensee will be required to shutdown, if restarted, by March 9, 2004, and conduct the SG inspection.

Discuss Communication Status A. Mendiola briefed the Panel on the Communications status. The Restart Communication Plan has been reviewed by the Panel Chairman and is being reviewed by the Region III Public Affairs staff.

The Communications Team will hold a meeting next Wednesday, January 21, 2004, to review correspondence items, assign a tracking number to each, and recommend dispositioning for each item. The Communication Team Tracking Matrix will be updated with the results and presented to the Panel for review.

Panel Discussion on Providing DRAFT Restart Communication Plan to the Commission J. Grobe led a discussion on the action to present a DRAFT version of the Restart Communication Plan to the Commission. The plan will be attached to a memorandum from J. Grobe which clarifies sensitivity of the information contained in the DRAFT plan and that the plan will be revised as required based on the licensees completion of corrective actions and assessed readiness for restart. The DRAFT plan is due to the Commission by next Friday, January 23, 2004.

NEW ACTION ITEM (238) - A. MENDIOLA TO DRAFT A MEMO FROM JOHN GROBE TO CALDWELL, DYER, AND COLLINS TO ACCOMPANY AND DISCUSS SENSITIVITY OF INFORMATION IN DRAFT RESTART COMM PLAN. (Due Date:

01/21/04) 6.

Brief Panel on CATI Report Review for Comments C. Lipa informed the Panel that the final draft CATI report is out for review and that comments are due back to P. Lougheed by tomorrow, 1/16/04.

J. Lara, C. Lipa, P. Lougheed, and Z. Falevits will meet next week to discuss issues involving the proposed Non-Cited Violations. One action will be to verify that the Significance Determination Process evaluation is complete for all issues characterized as minor and greater than minor. Another action is to resolve an action plan for moving forward with two issues that are still awaiting risk assessments from the licensee. Final significance determination is not possible without the information from the licensee. The specific issues are: 1) High Pressure Injection minimum recirculation flow, and

2) Containment Air Cooler fouling and performance.

Additionally, J. Grobe, J. Lara, C. Lipa, P. Lougheed, and Z. Falevits will meet next Tuesday, January 20, to conduct a final review of the licensee commitments listed in Revision 1 to the licensees Operational Improvement Plan and discuss the impact these have on the Confirmatory Order.

Update and Discussion on Licensees Plan to Revise/Update the Nov. 23 Integrated Readiness for Restart Report and Operational Improvement Plan C. Lipa led a discussion on whether or not the licensees Integrated Readiness to Support Restart report requires a revision. Some activities the licensee took credit for are now not being done, or have been changed. The Panel discussed having the

licensee issue an update or supplement to the report in place of a revision. Either way, the licensee needs to docket the changes. J. Grobe took an action to contact the licensee and request clarification on how they intend to address the issue.

Discuss Requirements/Action Items for Development of Presentation for Jim Caldwell/

Jim Dyer/Sam Collins A. Mendiola led a discussion of what actions are required to develop a Panel presentation for J. Caldwell, J. Dyer, and S. Collins. The major topics for the presentation will include a summary of completion of the Restart Checklist Items, Key messages from the Restart Communication Plan, future inspection planning, and review of the Restart Recommendation Memorandum and Confirmatory Order. The presentation should also include a slide which captures the NRC efforts to date for interaction with the public. A. Mendiola and C. Lipa will finalize an action plan for other key required activities to support the presentation to discuss at a future Panel meeting.

9.

Discuss Action Items C. Lipa led a review of the Open Action Items list. One new Action Item was added to the open action items list and one item was closed.

Discuss Punch List C. Lipa led a review of the Punchlist. R. Baker took the action to update the Punchlist with the Panels comments.

11.

Discuss/Update Milestones and Commitments The Panel reviewed and discussed upcoming milestones and commitments.
