MINUTES OF INTERNAL MEETING OF THE DAVIS-BESSE OVERSIGHT PANEL The implementation of the IMC 0350 process for the Davis-Besse Nuclear Power Station was announced on April 29, 2002. An internal panel meeting was held on November 25, 2003. Attached for your information are the minutes from the internal meeting of the Davis-Besse Oversight Panel, and the Open Action Items List.

Discuss/Approve Todays Agenda The Panel approved the agenda, but modified the order of presentations. THE APPROVED AGENDA REFLECTS THE ORDER LISTED IN THESE MINUTES.

Discuss Communication Status J. Stang briefed the Panel on the status of updating the Tracking Matrix, and suggested adding open RAM items to the Matrix. Help is available for updating the Matrix, so the updated Matrix will be presented at the next Panel meeting.
The Restart Q&As will be sent out to the region for final, and when completed, will be sent back to NRR. The Blackout Q&As will be handled by the Agency Communication Plan and J. Strasma. The Panel decided that Q&As addressing the Lochbaum website posting will be developed to provide amplifying and background information, but direct responses to the issues mentioned will not be provided.
Green Ticket 03-709, addressing the Donna Lueke letter from the last 0350 public meeting is being discussed with the EDO office for how to respond and A. Mendiola will keep the Panel updated.

Discuss Current Decision on Not Issuing a Proposed IN on the Topic of Adverse Effect of Boric Acid Leakage - Chemical Neutrality D. Hills led a discussion on what the next steps should be concerning the issuance of the proposed IN on the topic of adverse effect of boric acid leakage, and the impact on Trisodium Phosphate requirements. The CI was told that an IN would be issued at the time the allegation was closed. The NRR staff will review the letter sent to the CI, and move the issue along as required, as well as keeping the Panel updated on progress.

Brief Panel on HPI Pump Modification Package Review/Test-Observation Requirements S. Unikewicz briefed the Panel on the status of reviewing the licensees HPI pump engineering design modification package and results from the acceptance testing on the HPI pumps. S. Unikewicz observed the licensees HPI pump acceptance testings over
this past weekend, and revised the HPI pump TIA to reflect items witnessed during the pump testing. A thorough review of the licensees debris characterization model/
assumptions was performed prior to the testing. A draft copy of the engineering design modification package was also reviewed.
S. Unikewicz will provide feeder input to the Inspection Results memorandum NRR is providing to document closure of Restart Checklist Item 2.e by 12/11/03.

Discuss 50.9 Issue and Violation C. Lipa briefed the Panel that discussions are continuing on the decision to send a cited violation to the licensee for its failure to meet 10 CFR 50.9 resulting from the Completeness and Accuracy inspection (Inspection Report 50-346/03-019) findings.
When a final decision is reached the Panel will be updated.

Discuss Pending CATI Team Results (Service Water Swap & Others) and the Ability to Support Closure of Restart Checklist Items 3.a & 5.b C. Lipa led a discussion on open CATI issues and the ability to support closure of Restart Checklist items. The issues will be topics of discussion with the licensee during the weekly call. The CATI team needs to provide the licensee a clear understanding of what is required to resolve these issues and support closure of Restart Checklist Items.

Discuss Plant Status and Inspector Insights and Emergent Issues List S. Thomas led a discussion of plant status and inspector insights and emergent issues.
The plant is in Mode 5.
The FENOC Company Nuclear Review Board (CNRB) met Thursday, November 20 to receive subcommittee reports on readiness for restart. No safety concerns that would prevent restart were identified, with all six subcommittees giving restart approval. One of the subcommittees restart approval was conditional, pending completion of the Operations Improvement Action Plan.

Discuss Initial Feedback Available on the Licensees Integrated Report to Support Restart Submittal and Request for Meeting The Panel discussed the process to be used for review of the licensees Integrated Readiness to Support Restart. J. Stang and one representative from the Region will coordinate the review and presentation to the Panel. A date for holding the Public Restart Meeting is still being considered.
9.
Discuss New/Potential Licensing Issues J. Hopkins informed the Panel that there were no new licensing issues, and briefed the Panel on the issues being reviewed by NRR:
1)
Steam Generator Inspection Relief Request 2)
Revised SFAS setpoint - plans are to present to the CNRB on 12/10/03 and submit to NRR on 12/15/03
3)
EDG voltage and frequency licensing amendment - plans are to present to the CNRB on 12/17/03 and submit to NRR on 12/20/03.

Discuss Allegations: 1) New; 2) Determine If Required to Be Resolved Prior to Restart; and 3) Requested Extensions C. Lipa informed the Panel that there were no new allegations, and R. Daley is still challenging the licensee on the EDG Square D-relays.
11.
Review Final Draft of Confirmatory Order A. Mendiola led a discussion on the status of the draft Confirmatory Order. The Panel discussed the fact that the licensee has not formalized a commitment to performing a mid-cycle outage. J. Grobe discussed this with B. Allen and M. Bezilla at the last public meeting on November 12, and they said that a letter would be sent to the NRC establishing the commitment for a mid-cycle outage. The Panel provided several comments on the remaining sections of the draft Order. A revised draft will be sent to F. Lyon by next Monday, 12/01/03.
12.
Discuss Licensees Proposed Agenda for 12/03 0350 Public Meeting Presentation The Panel discussed the licensees proposed agenda for the next public meeting. One item of note is that the licensee has had two surveys conducted in the SCWE area and has not submitted an assessment of the surveys. J. Grobe will inform the licensee that this would be an appropriate topic for discussion at the upcoming public meeting.

Discuss Punch List C. Lipa led a review of the Punchlist. R. Baker took the action to update the Punchlist with the Panels comments.
14.
Brief Panel on the Results from the Backlog Inspection (Inspection Report 50-346/03-024) Exit and Licensees Plan to Respond to the Greater Than Green Finding for HPI Pumps M. Parker briefed the Panel on the preliminary results from the Engineering and Maintenance Backlog inspection. An assessment of the risk significance of the Backlog was performed by reviewing 10 systems with the highest risk significance. Following a comprehensive review of associated paperwork, the inspectors concluded that the risk significance of the Backlog does not present a concern which could impact restart of the plant. Some concerns noted by the inspectors were:
1)
A substantial resource commitment by the licensee will be required to work-off the backlog and contractors will likely be required to do much of the work, 2)
Although the licensee has performed adequate post restart categorization of the backlog, schedules are not clear or well defined for completing the task, and 3)
Continued Management involvement will be required to complete development of task schedules and ensure focused attention on a daily basis.
M. Parker also briefed the Panel on the licensees efforts to date concerning the Greater than Green finding for the HPI pump deficiencies. The licensee has contracted out the analysis of debris transport model. The risk assessment effort is focused on feed &
bleed and small loss of coolant accident scenarios. M. Parker was also informed by the licensee that they will continue the effort until 12/05/03 and then submit what they have to the NRC. S. Burgess will continue communicating with the licensee and review the risk assessment submittal when received.
15.
Discuss Items for Licensee Weekly Calls C. Lipa led a discussion of specific issues to address with the licensee during the weekly call. Two additional items identified for discussion were: 1) Discuss status of resolving the issue involving EDG Square-D Relays, and 2) The licensees proposed actions concerning the Service Water Swap.
16.
Discuss Update Milestones and Commitments The Panel reviewed and discussed upcoming milestones and commitments.
