MINUTES OF INTERNAL MEETING OF THE DAVIS-BESSE OVERSIGHT PANEL The implementation of the IMC 0350 process for the Davis-Besse Nuclear Power Station was announced on April 29, 2002. An internal panel meeting was held on December 11, 2003. Attached for your information are the minutes from the internal meeting of the Davis-Besse Oversight Panel.

MEETING MINUTES: Internal IMC 0350 Oversight Panel Meeting Davis-Besse Nuclear Power Station DATE: December 11, 2003 TIME: 8:30 a.m. Central ATTENDEES:

1. Discuss/Approve Todays Agenda The Panel approved the agenda, but modified the order of presentations. THE APPROVED AGENDA REFLECTS THE ORDER LISTED IN THESE MINUTES.
2. Discuss the Licensees Data from the November 2003 SCWE Survey, Grouped by Departments J. Grobe led a discussion on the licensees recently submitted November 2003 SCWE Survey data showing the breakdown by departments. The data shows a marked decline in numerous key questions across several departments when compared to the March 2003 survey results. J. Grobe and G. Wright will review this data with the licensee and brief the Panel at a future meeting.
3. Discuss Plant Status and Inspector Insights and Emergent Issues List S. Thomas led a discussion of plant status and inspector insights and emergent issues.

The plant is currently in Mode 5 with a bubble in the Pressurizer. Circulating water flow has been established in the condenser and the licensee has begun drawing a vacuum.

The licensees schedule denotes Mode 4 by 12/14/03, NOP/NOT by 12/17/03, and Mode 2 by 12/20/03.

Evaluation of the HPI baseline testing shows a pump performance less than expected.

The noted issue is in the 200 - 300 gpm operating points, which may not meet the minimum required flow for the LOCA basis. The licensee is discussing how to resolve this issue, and this may prove to be the critical path for plant restart.

The Panel was briefed on continuing federal government follow-up to the August 2003 blackout focusing on FirstEnergy grid reliability.

4. Discuss New/Potential Licensing Issues J. Hopkins informed the Panel that there were no new licensing issues. A teleconference is setup with the licensee at 1:00 p.m. (EST) today to discuss the issues involved with Steam Generator inspections, and will brief the Panel at the next meeting.
5. Discuss Allegations: 1) New; 2) Determine If Required to Be Resolved Prior to Restart M. Phillips informed the Panel that there were no new allegations.
6. Discuss Comments on the Draft Recommendation Memo to Regional Administrator M. Phillips led a review of the draft Restart Recommendation memorandum to the Regional Administrator. The Panel had one major comment on the body of the recommendation, in that the Order and the basis for the Order should be described.

The remainder of the review comments dealt with the required attachments to the memorandum.

1) The Panel Process Plan - should be complete and up to date through all sections necessary to deliberate on the restart decision. (Sections B.1 through B.4)
2) The Restart Checklist Closure Basis Table - this table will cross reference each Restart Checklist Item to the specific inspection reports that assess the items and document closure of the items.
3) The Closed Restart Action Matrix (RAM) Index - the index table will cross reference all RAM Items to the specific Panel meeting which approved closure of the specific RAM Item.

The Panel suggested having all the attachments reviewed by an uninvolved person to validate completeness and accuracy.

7. Discuss Status of Draft Confirmatory Order Concurrences F. Lyon led a discussion on the status of the Confirmatory Order. Office of General Council has a revised wording of part of the Order in typing and will forward when complete. The Panel concurred on the need to expedite the final input from all groups so that F. Lyon has all inputs by the close of business today. The Panel also needs to review the November 2003 SCWE data again compared to language in the Order.

Once all inputs are incorporated in the final revision, one meeting will be scheduled to allow all required concurrence staff to review and finalize the Order.

8. Discuss Punchlist C. Lipa led a review of the Punchlist. R. Baker took the action to update the Punchlist with the Panels comments.
9. Brief Panel on New Insights from CATI Public Meeting and Status of Ability to Close Restart Checklist Item 3.a, Corrective Action Program C. Lipa briefed the Panel on key issues and topics discussed during the public meeting with the licensee held yesterday in the Region III offices concerning open CATI technical issues and the ability to close Restart Checklist Item 3.a, Corrective Action Program.

The CATI team stated that the major remaining concern is the basis for confidence that

the licensees corrective actions will remain effective in the future. The specific issues discussed are listed below.

1) The Corrective Action Program as evaluated in the March 2003 inspection was adequate with the exception of roll-overs. The program was modified and corrected to address the roll-over process. The deficiency noted by the CATI inspection team concerned effective implementation of the program. The question discussed with the licensee concerned their Corrective Actions to address all identified deficiencies.
2) The CATI team expressed concern about the consistency of engineering calculation quality and corrective actions taken to ensure that the calculation improvement program would result in lasting improvement. The licensee committed to expand the role of the Engineering Assurance Board (EAB) to include review of all calculations and provide the resumes of the EAB to the CATI team.
3) The CATI team noted that the licensee has not yet approved the revised procedure for conducting self-assessments.
4) The CATI team expressed a concern about the recent resumption of the corrective action trending program. The licensee stated the last quarterly report of trending will be sent to the CATI team lead.

The Panel discussed these issues and has requested the CATI team continue to review these issues and share their basis for Item 3a assessment with the Panel. At that time, the Panel will determine what further actions, if any, are necessary.

The Panel also concurred that it is not possible to discuss closure of Restart Checklist Item 3.a until these issues are defined and resolved.

10. Discuss Update Milestones and Commitments The Panel reviewed and discussed upcoming milestones and commitments.
