MINUTES OF INTERNAL MEETING OF THE DAVIS-BESSE OVERSIGHT PANEL The implementation of the IMC 0350 process for the Davis-Besse Nuclear Power Station was announced on April 29, 2002. An internal panel meeting was held on April 14, 2005.
Attached for your information are the revised minutes from the internal meeting of the Davis-Besse Oversight Panel and the Open Action Items List. The minutes were revised to modify the Action Item Table: Item No. 283.

Discuss/Approve Todays Agenda The Panel approved the agenda. THE APPROVED AGENDA REFLECTS THE ORDER LISTED IN THESE MINUTES.

Discuss Plant Status and Emergent Issues C. Thomas discussed plant status. The plant has been at or near 100 percent power since the last panel meeting on March 24. This past weekend there was a step-increase in the unidentified leakage from approximately 0.03gpm to approximately 0.25gpm. This was accompanied by an increase in the containment sump level and a decrease in the Makeup Tank level. A containment tour revealed no leakage to the accessible floor drains. The licensee then noticed that the RCS Drain Header was being pressurized by leakage from at least one of the RCS low point drain valves. Upon opening the drain header, the sump level stabilized and the reactor coolant drain tank (RCDT) level began increasing. The licensee is currently working through their Problem Solving and Decision Making Plan, which includes efforts to better quantify identified and unidentified leakage. The licensee currently has no plans to shut down the plant to evaluate the low pressure drain valves. The licensees response to this issue thus far appears to be adequate.
Circulating Water Pump #4 will be returned to service soon. This will allow the plant to continue operating at 100 percent power as the weather warms up.

Discuss Status of Enforcement Actions Pending for Davis-Besse M. Phillips updated the Panel on the head degradation-related enforcement activities. A Communications Plan has been drafted and will go final soon. A SECY Paper, letter to the individual, letter to the licensee, NOV, and Notice of Civil Penalty have gone to the Commission. The expected T=0 date is Friday, April 15, however OPA would prefer a Thursday release to allow for better notification of external stakeholders and the public.
The remainder of the enforcement action regarding the vessel head degradation / boric-acid control program should be complete within the next couple months.
C. Lipa updated the Panel on the issuance of the White finding regarding the sirens.
The enforcement package is not final yet but we are moving forward. The enforcement action will come out before the plant is removed from the IMC 0350 Process.

Discuss Process Plan & POAM C. Lipa updated the Panel on the Process Plan and the POAM.
The Process Plan lays out the final decision-making steps for returning Davis-Besse to the Reactor Oversight Process. A. Stone and J. Hopkins have issued a survey to involved NRC staff requesting their input on returning Davis-Besse to the ROP. The Panel will take action based on the survey results if it is necessary.
Team Leads are expected to review the commitments in the POAM to determine which ones will need additional reviews once Davis-Besse returns to the ROP; Panel approval will be needed.

Discuss Strategy to Exit 0350 regarding the Safety Culture/Safety Conscious Work Environment (Return to ROP) & Special Inspection Needs G. Wright is on-site this week and will brief the Panel at the next meeting.

Discuss Memo to Caldwell re: Exiting 0350 Process The memo recommending the termination of the 0350 Panel is based on the D.C. Cook 0350 termination letter. The Panel will provide C. Thomas with comments for the memo.
A. Garmoe has started a Communications Plan regarding termination of the 0350 Panel.

Discuss Deviation Letter to EDO The format of the deviation letter will be similar to the Indian Point 2 and Salem/Hope Creek deviation letters. The Panel will hold a call with IIPB to discuss closing the red finding; this will help determine which column of the Action Matrix Davis-Besse will enter.
All necessary inspections for the red finding have been conducted but we are waiting for the enforcement portion to be issued. The call with IIPB will specifically discuss whether the finding can be closed prior to issuance of the enforcement action.

Discuss New/Potential Licensing Issues (Standing Item) and Any Issues from Bi-Weekly Calls on Fridays Due to J. Hopkins absence today, this discussion will be deferred to the next Panel. No members present were aware of any new licensing issues.

Mr. Hopkins will provide a feeder to C. Thomas for the next inspection report discussing the issue in detail and dispositioning it in accordance with the Enforcement Policy.
C. Thomas will review the related Condition Report for the item.
