Dear Mr. Bickwit:

During the week of April 26, 1982, Richard Abbott, Commissioner Gilinsky's Technical Assistant, came to the Zimmer Station and spent one or two days conducting his own inspection of the plant. While in Cincinnati, I understood that he conducted ex parte discussions with Mr. Thomas Applegate, a represelitative of CARE, and Mr. Thomas Devine, a representative of GAP, which as you know are seeking to reopen the captioned proceedings. He also taked with Mr.

Andrew Dennison, counsel for ZAC-ZACK, local anti-nuclear groups, which intervened in opposition to the issuance of an operating license.

Mr. Abbott advised The Cincinnati Gas & Electric l Company personnel at the Zimmer Station that he had l contacted these individuals on advice of Commission counsel, presumably from your Office. However, neither Mr. Abbott nor anyone else on his behalf made any effort to notify l counsel for the Company, or as far as I know, counsel for l

the NRC Staff.

As counsel of record for the Company, I request that either the office of the Vice President and General Counsel of The Cincinnati Gas & Electric Company, William J. Moran, or my office be notified of any future visits by Commissioners, members of their immediate staffs, or other NRC employees who advise the Commissioners, as provided in 8206240163 820618 PDR ADOCK 05000350
