Dear Ms. Bauser:

This is in further response to your letter dated May 22, 1984, in which you requested, pursuant to the Freedom of Information Act (F0IA), copies of all agency documents relating to the October 1983 report by Judge Helen Hoyt and Sebastian Alcot on NRC investigations at the Zimmer nuclear power station. In responding, we have construed your request to encompass only those documents generated or reviewed by the investigation team.

A listing of the responsive documents is enclosed. The following documents are being released in their entirety in connection with this response: 35, 51, 52, 73, 86, 93a, 93b, 125, 131a, 150, 152, 153, 154, 156, 166, 168, 169, 214, 215,.and 249. These documents are being placed in the NRC Public Document Room, 1717 H Street, NW, Washington, DC 20555. In addition, copies of these documents are enclosed. Upon completion of your F0IA request, we will advise you of the total cost for reproduction. I-The following documents are being withheld in their entirety: 155, 157-161, 165 and 171. These documents are being withheld (7)(D) of the F0IA (5 U.S.C. 552(b)(5) and (7)(D) ) and 10pursuant to Exemptions CFR 9.5(a)(5) and (5) an (7)(iv) of the Commission'r regulations. Release of these documents would reveal confidential information furnished by individuals who were interviewed by the investigation team and would reveal privileged information.

Pursuant to 10 CFR 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The person responsible for this denial is Mr. C. Sebastian Alcot, Office of the General Counsel.

This denial may be appealed to the Secretary of the Commission within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Secretary of the Commission, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."

The report and some of its exhibits were previously made public in response to an earlier Freedom of Information Act request (FOIA 8 3-558) , but the back-up documentation, though apparently collected and reviewed, was not placed in the Public Document Room. Since this review and collection has already occurred, I would appreciate your prompt response to this request.
