Re: Appeal from Initial FOI Decision FOIA-83-684

Dear Mr. Chilk:

In accordance with the Freedom of Information Act and 10 C.F.R. $39.11(a) and 9.15 (a) , I hereby appeal from the initial

! denial of my FOIA request dated November 23, 1984 (see Attachment A) by letters from J. M. Felton dated January 11 and 18, 1984 (see Attachments B and C) . The January 11 letter (Attachment B) denies Paragraph 1 of my request. The January 18 letter (Attach-ment C) statos that there will be an indotorminato delay in responding to Paragraph 2 of my request. This responso neither complies with the time limits established by 10 C.F.R. 559.9 and 9.13 nor proposes a specific extension of timo for responso as required by 10 C.F.R. $9.9(d). Accordingly, since it appears that I will not roccive a timely response to Paragraph 2 of my request, I am treating the January 18 letter as a denial pursuant to 10 C.F.R. 59.9 (e) .

I look forward to your prompt consideration and resolution of this appeal.
