Dear Mr. Hickey:

This is the final response to your letter dated November 23, 1983, in which you requested, pursuant to the Freedom of Information Act (F0IA), documents concerning the William H. Zimer Nuclear Power Station.

The documents listed on the enclosed computer printout were located in the Office of Investigations (01) as of February 27, 1984. Since that time approximately 15 inches of documents have been added to the files. As you may know, certain matters concerning Zimer have been provided to the Department of Justice. All of the documents contained in the 01 files concerning the William H. Zimer Nuclear Power Station are being withheld from public disclosure pursuant to Exemptions (5), (7)(A), (7)(C), and (7)(D) of the F0IA (5 U.S.C. 552(b)(5), (7)(A), (7)(C), and (7)(D)) and 10 CFR 9.5 (a)(5),

(7)(1), (7)(iii) and (7)(iv) of the Commission's regulations. These records are withheld in their er,tirety because they are predecisional in nature or their release could cause an unwarranted invasion of personal privacy, disclose confidential sources, or interfere with an ongoing enforcement proceeding.

Pursuant to 10 CFR 9.15 of the Comission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The person responsible for this denial is Ben B. Hayes, Director, Office of Investigation.

This denial may be appealed to the Comission within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Secretary of the Comission, U.S. Nuclear Regulatory Comission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."

Inasmuch as this completes NRC's action on your request and you have the right to appeal this denial, the NRC is taking no further action on your appeal letter dated February 10, 1984.

The transcript of the November 15, 1983

" Discussion of Pending Investigations" held before the Commission, insofar as the discussion concerned the William H.

Zimmer Nuclear Power Station.

2.

All documents prepared on or after July 1, 1983, which discuss or support the NRC Staff's decision not to approve the Cincinnati Gas & Electric Company's proposed Course of Action for Zimmer, as reflected in the attached letter dated November 21, 1983 from James G.

Keppler, Regional Administrator, to the Cincinnati Gas & Electric Company.

I advised Mr. Williams that based upon information obtained to date frem the Office of Investigation's ongoing investigation at Zimmer, the NRC staff is not able to approve Cincinnati Cas and Electric Company's proposed Course of Action for Zimmer with the described role for the

!!. J. Kaiser Corporation.

While the results of the NRC investigation, which is not expected to be completed for several more months, may prove more favorable to Kaiser, we cannot,pprove the Course of Action with the information we have developed te date.

Based on our meetinr, we understalid CG&E will respond to this matter to deal with the staff's concerns.
