Dear Mr. Cunningham:

As you know, pursuant to Public Law 96-368 and a Cooperative Agreement between the United States Department of Energy (" DOE") and the New York State Energy Fesearch and Development Authority (the

" Authority"), an important national high-level radioactive waste management project (the " Project") is being carried out at the Authority's Western New York Nuclear Service Center in West Valley, New York. The Project plans include utilization of the Fuel Receiving Facility ("FRF") at West Valley for storage of the solidified high-level radioactive waste. The FRF will also be decontaminated and decommissioned as part of the Project.

As you also know, spent fuel is still located in the FRF at West Valley. The Authority has been using its best efforts to arrange for the timely and assured removal of the spent fuel, to minimize any further conflict with the Project plans and activities. The Authority has reached agreement with Nuclear Fuel Services, Inc. and Fochester Gas and Electric Company for such removal of their spent fuel from West valley. Ameng the other spent fuel currently located at West Valley are 114 spent fuel assemblies owned by Wisconsin Electric Power Compapy

("WEFCC") , which were discharged from WEPCO's Point Beach Station near Two Rivers, Wisconsin. In response to inquiries regarding its spent fuel, WEPCO has stated to the Authority its " understanding that_the receipt of Point Beach spent fuel (currently located at West valley) at the Point Beach plant for subsequent storage is authorized under Point Beach's current operating license." (WEPCO has also stated that only ]g 376 spent fuel assemblies are current 1v stored in the Point Beach nuclear fuel storage pool, which has a total capacity of 1,502 nuclear fuel assemblies.)

e The Authority and WEPCO will soon be meeting to try to conclude arrangements for the return oi the WFPCO spes.*. fuel, to the Point Beach Station. Confirmation of WEPCO's understanding would be very helpful, to f acilitate completing arrangements for the expeditious removal of WEPCO spent fuel from West Valley and minimizing any further conflict with the Project. Accordingly, the Authority requests confirmation that, consistent with jgEP_CO's licenses related to the Point Beach station, WEPCO_may receive and store at the Point Beach Station the 114 spent fuel assenblies discharged from the Point Beach 3tation which are currently located at West Valley. .
