I have your letter of August 13 advising that Mr. Osann would'2 -
not be available on August 20 for the purpose of deposition.
If on July 17 you advised me of a personal commitment which precluded your availability on August 20, I had forgotten it and did not intentionally schedule Mr. Osann's deposition to conflict with your schedule. I apologize for this oversight on my part. As you know, I have never objected to rescheduling depositions to meet the convenience of the parties or the deponents.
I suggest that Mr. Osann's deposition be rescheduled for any of the following dates: September 2, 4, 5, 8, 10, 11, 14, 15, 16, 17, 18, 19, 21, 22, 23, 24, 25, 26, 28, 29 or 30. I recognize that you have requested the Board to issue subpoenas for taking of depositions of various people ou many of the suggested dates; however, the Board has not granted your request for any subpoenas at this time and thus all of the above-referenced dates should be available for the taking of the deposition of Mr. Osann.
