OF AUGUST 17, 2005, MEETING TO DISCUSS THE LICENSE AMENDMENT REQUEST FOR A DIGITAL REACTOR PROTECTIVE SYSTEM AND ENGINEERED SAFEGUARDS PROTECTIVE SYSTEM (TAC NOS.

On August 17, 2005, the Nuclear Regulatory Commission (NRC) met with Duke Energy Corporation (the licensee) to discuss the February 14, 2005, license amendment request for a digital Reactor Protective System and Engineered Safeguards Protective System. Enclosure 1 is a list of the attendees. Enclosure 2 is the handouts provided by the licensee during the meeting.

The NRC staff stated that it is relooking at the operator action times provided in the March 20, 2003, defense-in-depth and diversity analysis. The NRC staff is looking for more justification on the reliability of the operator actions and will be providing some additional questions to the licensee.

The licensee presented the status of its responses to questions that had been previously provided by the NRC staff. The NRC staff agreed that some of the questions had been answered satisfactorily, but that additional information was still needed on some of the other questions. The NRC staff stated they will be sending to the licensee a formal request for additional information that will include some new questions.
