On March 5, 2013, the U.S. Nuclear Regulatory Commission (NRC) staff held a Predecisional Enforcement Conference (PEC) with you and members of your staff at NRC Headquarters in Rockville, Maryland. The PEC was requested by Duke Energy Carolinas, LLC, folloWing the NRC's issuance of a letter stating an apparent violation related to the Oconee Nuclear Station license conditions on fire protection. That letter was dated January 31, 2013, and is available from the NRC's website, www.nrc.gov, under the Agencywide Documents Access and Management System Accession No. ML13017A456. A brief summary of the PEC proceedings is enclosed.

PREDECISIONAL ENFORCEMENT CONFERENCE

50-269, 50-270, and 50-287 EA-13-010 On March 5, 2013, representatives of Duke Energy Carolinas, LLC (the licensee) met with NRC personnel at NRC Headquarters located in Rockville, Maryland, to discuss the apparent violations of the license conditions in regard to fire protection which were identified in an NRC letter dated January 31, 2013. The conference was held at the request of the licensee. The license conditions are related to the completion of the licensee's transition to a fire protection program based on the National Fire Protection Association (NFPA) Standard NFPA-805.
The licensee presented a summary of the causes for the apparent violations, additional compensatory actions and their corrective actions. The presentation material used by the licensee is available from the NRC's website, www.nrc.gov, under the Agencywide Documents Access and Management System Accession No. ML13064A102. The accession number can be entered in the search box at the upper right of the home page in order to locate the document.
The licensee agreed with the apparent violations as described in the NRC's letter, and stated that the significance of the apparent violations should be considered at Severity Level III. The licensee described compensatory actions that they have taken and the causes of the delays that have been identified by their evaluation team. The licensee also described corrective actions that have been completed, and planned corrective actions. The NRC staff asked questions to clarify certain aspects of the apparent violations.
The NRC's purpose in conducting this meeting was obtain information from the licensee that will assist us in determining the appropriate enforcement decision. The NRC staff did not make any enforcement decisions at this meeting. A final enforcement decision is expected by April 30, 2013.
The attendance list for people present at the PEC is attached to this summary. Additional members of the public participated by teleconference. In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this summary and its attachment will be made available to the public.
