SUMMARY

OF SEPTEMBER 26-27, 2005, MEETING TO DISCUSS THE LICENSE AMENDMENT REQUEST FOR A DIGITAL REACTOR PROTECTIVE SYSTEM AND ENGINEERED SAFEGUARDS PROTECTIVE SYSTEM (TAC NOS. MC5895, MC5896, AND MC5897)

On September 26-27, 2005, the Nuclear Regulatory Commission (NRC) met with Duke Energy Corporation (the licensee) to discuss the February 14, 2005, license amendment request for a digital Reactor Protective System (RPS) and Engineered Safeguards Protective System (ESPS). Enclosure 1 is a list of the attendees. Enclosure 2 is the slides presented by the licensee during the meeting.

The licensee presented its schedule for responding to the NRC staffs requests for additional information (RAI) and its schedule for implementation. The licensee stated that the design of the hardware and software is 90 percent complete and 100 completion is expected by the end of September 2005. The licensee is planning to install the digital RPS/ESPS on Oconee, Unit 1 during the Fall 2006 refueling outage.

The licensee stated that it is conducting simulator tests to justify the times assumed in the defense-in-depth and diversity analysis. The results of these tests will be discussed at a later time.

The licensee and the NRC held a detailed discussion on the two issues for which the NRC has concerns, the use of interchannel connections and the combining of RPS and ESPS into a single system. The licensee believes that the use of interchannel connections provides a safety benefit and that the combining of RPS and ESPS provides adequate safety. The licensee requested that the NRC staff provide its position on these two issues by the end of October 2005, so that the schedule for installing can be achieved.
