REPORT NO. 70-1113/84-18 Thank you for your response of February 28, 1985, to our Notice of Violation

-issued on January 31, 1985, concerning activities conducted under NRC License SNM-1097. Although your letter indicated that you agree with the subject Notice of Violation, the letter requested consideration of reduction of the Severity Level from Level IV to Level V.

Our evaluation of your response indicated that your response did not provide cause to reduce the Severity Level in accordance with criteria set forth in 10 CFR 2, Appendix C (VII), Supplement VIII. The decision not to reduce the Severity Level is based on the need for emergency implementing procedures to be clear and explicit concerning the actions and responsibilities of the user of such procedures, so as to facilitate timely and appropriate actions. Although your reply correctly states that the advisor's procedure addresses notification and protective action recommendations, it is necesary that the Emergency Director procedure be specific and clearly delineate those actions that are the responsibility of the Emergency Director in the area of offsite notification and protective action recommendations. This failure is considered to be of more than minor safety significance.

- Our review of your response found that it meets the requirements of 10 CFR 2.201.

We will ' examine the implementation of your corrective actions during future inspections.
