Dear Judge Hoyt:

In view of the recent Motions for Clarification filed by counsel for the staff and the Board 's reponse thereto, SAPL wishes to make it clear to the Board and to the parties that its response to the Applicant's Petition pursuant to 10 CFR 2.758 is solely addressed to the issue whether or not the applicants have established a prima facie case for waiver of the Commission 's emergency planning requirements. SAPL believes this is all that is feasible within the time limits provided by the Board.

Therefore, SAPL's response is directed toward the question of whether or not a prima facie showing has been made.

SAPL's filings on this issue are all it intends to furnish.

Should there be a determination that a prima f acie showing has been made, SAPL would then expect that further fact finding procedures would be established to determine whether or not a waiver should be granted.
