I regret that lack of communication on-SAPL's part created any confusion as to SAPL's intentions in regard to the oral
-argument on appeal of the Licensing' Board's decision not to address:the issue of the financial qualification of Seabrook's owners for full power operation.
SAPL is not. intending to participate in the oral argument on July 12, 1989 but will stand y
j' on'its brief' filed with the? Appeal Board on April.13, 1989.
Mr.
Traficonte has conveyed to me that he will be arguing the. appeal only for the Massachusetts Attorney General.
.As not&d in SAPL's brief at p. 7, it is the merits of the issue of the financial qualification of Seabrook's owners to operate-the plint this is'of central concern rather'than the procedural. issue'of whether the Board erred in disallowing SAPL's late. filed' contention.
Again, you have my apologies for any inconvenience caused to the Appeal Board or your staff by our lack of explicit notification regarding SAPL's decision not to participate in tomorrow's oral argument.
