Dear Mr. Chilk:
l This is to advise the Commission that the Seabrook intervenors intend to prepare and.Jile a further affidavit in regard to the intervenors emergency motion to re-open the record on the adequacy of staf fing of the NHRERP and for immediate shutdown.
The original motion, filed on behalf of SAPL, Attorney General of Massachusetts, and NECNP on August 7, has now produced responses both from the licensee and the NRC staff.
The staff's response was received by the undersigned only on August 27.

Both responses contain affidavits purporting to show that the i
affidavit of Mr. Michael Sinclair was wrong when it contended that
'I the staffing to implement the NHRERP had' fallen below the necessary minimums.
We believe that the affidavi+.s offered by the licensee and the I

staff are incomplete (for e). ample, there is no indication that the persons said to be available are. knowledgeable or trained),
l and therefore may be nisleadincl.
In order to deal with.this, SAPL requested the actual personnel rosters from the State of New Hampshire, which were only received by a SAPL member on August 27, and have not yet been completely' reviewed by.either counsel or Mr.
Sinclair.
