HOPE CREEK GENERATING STATION CASE NO. 92-4-15-0920-49 On April 15, 1992, PSE&G reported a discharge of Compressor Oil to a stone surfaced area on the west side of the Salem Generating Station Solid Rad Waste Building.

The discharge was assigned Case No. 92-4-15-0920-49 by Operator 6.

1 Upon investigation it was determined that the reported discharge was, in fact, to an impermeable surface as defined in NJAC 7:1E-1.6 and was cleaned up immediately and removed prior to any escape into the waters or the lands of the state in accordance with the requirements of the definition of " leak".

It is our interpretation of the regulations that as this incident involved a leak onto a surfaced area and was cleaned up immediately as provided in NJAC 7:1E-1.6, it is exempt from this reporting requirement.

PSE&G believes and maintains that it has acted in accore with

the intent of NJAC 7:1E-5.3 which requires all major fact._cies to notify NJDEPE of discharges of potentially hazardous substances in any. concentration.
