C I have enclosed a rough draft of forty-five (45) potential Contentions for your consideration and a basis for our discussion next week.
I do not regard'this as a filing, and you are the only person who is receiving a copy of our proposed Contentions.
I am going to continue to investigate the possibilities for Contentions up until the deadline for submission of Contentions, but this is a complete list of what I have to date.

Eselosed is the stipalation covering the contentions proposait by ACORN for admission as issues in controversy in this proceeding. The stipulation has been signed by counsel for the Applicants and Staff and includes as an attach-meet a statensat of ACORN's proposed contentions.
The stipulation and attachment differ in some respects from the draft statement
(
of.coatentions and draft stipulation forwarded to you in August and October 1979, respectively. The draft statement of contentions and draft stipulation reflected the positions taken by the parties at the July meeting of the parties and la the parties' telephone conferences of Angust 31, 1979. As you recognise, these positions were act final. As a result of further negotiations betwee's the parties subsequent to the meeting of the parties in July 1979 and telephone conference of Angust 31, 1979, there has been a change of position with respect to several contentions. In particular, we note that the draft stipulation, indicated that the parties had agreed to defer seasideration of contention 24.*f Bowever, the parties have now agreed that deferral is no longer acessaary and have takaa positions with respect to this contention. Also note a change in the position of the Applicants regarding contentica 2.
The stipulation and attachment also now reflect the request of the Applicants and staff that the Licensing Board defer ruling on the admis.sibility of contention 25. The language of contentions 3.,
5., and 12. has been changed to conform to the language agreed to by the parties at their July aceting. In addition, the contention designated as number 33 la the draft statement of contentions has been deleted, since ACORN agreed at the meeting to withdraw this contention. Based on our records, these are the saly changes of substance in the stipulation and statement of contentions.

As the stipulation and statement of contentions indicate, the contentions have been renumbered. Unless otharvise acted, we are referring to ths eententions as renumbered.

On January 25, 1980, the NRC Staff filed a " Status Report on Proposed Stipuls-tions and Request to Schedule Prehearing Conference." This report responded to the request of the Atomic Safety and Licensing Board (the Licensing Board) for an appraisal of the status of negotiations among the parties to this pro-ceeding concerning the contentions of the respective Intervenors. The report reflected the Staff's belief, on that date, that the stipulations on contentions which had been executed by the Applicants and the Staff would shortly be executed by the Intervenors. Accordingly, the Staff 1) suggested that the Licensing Ecard schedule a prehearing conference on P. arch 20, 1980, to hear oral argument on contentions and 2) proposed that the parties file statements of position on contentions on February 29, 1980.
Since the filing of the Staff's status report, the stipulatiens have not been executed by the Intervenors. The staff continues to be hopeful that it will be possible to reach a stipulation on contentions. However, since the parties have not yet reached such a stipulation, the Staff believes that it would be pre: nature to file statements of position on contentions on February 29, 1980, especially since the Licensing Board is not considering having a prehearing conference until April 30, 1980.
The Staff therefore does not intend to file a statement of position on contentions on February 29, 1980.
In the event that the parties reach a stipulation on contentions, it is the Staff's inten-tion that the stipulation provide that the parties will file statecents of position on contentions no later than twenty (20) days prior to the holding k
