I herby withdraw that portion of our January 31, 1986, 2111ng CASE Request for Imposition of Fine, for Suspension of Construction Activities and for a Hearing on Application to Renew Construction Permit (docket #50-445-CPA) that requested remedial relief in the form of a suspension of all work activities and a ;
construction permit hearing on the basis of the settlement agreement reached between CASE, TU, and the NRC.
CASE does not, however, withdraw its request for some type of escalated enforcement action and leaves any such decision to ,
the discretion of the NRC Office of Enforcements.
