Dear Mr. Singer:

On May 4, 2006, the U.S. Nuclear Regulatory Commission (NRC) issued the renewed licenses for Browns Ferry Nuclear Plant (BFN), Units 1, 2, and 3. Subsequently, with input from your staff, the NRC identified administrative errors in the Technical Specifications (TS) included with the renewed licenses, and a typographical error on Page 5 of the Renewed Facility Operating License, Unit 1, No. DPR-33. As you are aware, when we issue a renewed license our intent is not to change the TS. However, due to administrative errors some of the TS pages included as Enclosures 1, 2, and 3, Technical Specifications, Appendix A and B for BFN, Units 1, 2, and 3, in the renewed licenses were incorrect. Description of the corrections are provided in Enclosure 1. This does not affect your obligation to adhere to any other license conditions contained in the renewed license for each unit.

Item 2 - In the NRC Copy, Unit 1, Pages 3.5-7, 3.8-33, 3.8-34, 3.8-35, 3.8-36, and 3.8-37 are not updated.

Disposition: NRC updated pages with Amendment No. 254, dated June 20, 2005. Pages have been replaced. Please see Accession No. ML061140352.

Item 3 - In the NRC Copy, Unit 1, Page 3.6-40 is not updated.

Disposition: NRC updated page with Amendment No. 255, dated July 18, 2005. Page has been replaced. Please see Accession No. ML061140352.

Item 4 - In the NRC Copy, Unit 2, Page 3.3-7a was applicable for Cycle 10 operation only.

Unit 2 is currently in Cycle 14.

Item 5 - In the NRC Copy, Unit 3, missing Pages 3.10-21 through 3.10-25, 4.0-1 through 4.0-3, and 5.0-1 through 5.0-30.

Item 6 - In the NRC Copy, Units 1, 2 and 3, Appendix B - NRC Copy contains the deleted Appendix B pages. These pages were deleted in TS 381, Amendments 237, 262, and 222, dated December 16, 1999.

Item 7 - NRC issued Unit 1 Renewed License, Pages 5 and 6 - Bottom of Page 5 has Item F -

Top of Page 6 has Item H. Item G was skipped.

Disposition: Replace Page 5 of the Unit 1 Renewed License (DPR-33) with Enclosure 2, which is hereby corrected.

Browns Ferry Nuclear Plant shall implement and maintain in effect all provisions of the approved Fire Protection Program as described in the Final Safety Analysis Report for BFN as approved in the safety evaluations dated December 8, 1988; March 6, 1991; March 31, 1993; November 2, 1995; and Supplement dated November 3, 1989; subject to the following provision:

The licensee may make changes to the approved fire protection program without prior approval of the Commission only if those changes would not adversely affect the ability to achieve and maintain safe shutdown in the event of a fire.

The licensee shall maintain the Augmented Quality Program for the Standby Liquid Control System to provide quality control elements to ensure component reliability for the required alternative source term function defined in the Updated Final Safety Analyses Report (UFSAR).

The licensee is required to confirm that the conclusions made in TVAs letter dated September 17, 2004, for the turbine building remain acceptable using seismic demand accelerations based on dynamic seismic analysis prior to the restart of Unit 1.

D.

The UFSAR supplement, as revised, submitted pursuant to 10 CFR 54.21(d),

shall be included in the next scheduled update to the UFSAR required by 10 CFR 50.71(e)(4) following the issuance of this renewed operating license.

Until that update is complete, TVA may make changes to the programs and activities described in the supplement without prior Commission approval, provided that TVA evaluates such changes pursuant to the criteria set forth in 10 CFR 50.59 and otherwise complies with the requirements in that section.

E.

The UFSAR supplement, as revised, describes certain future activities to be completed prior to the period of extended operation. TVA shall complete these activities no later than December 20, 2013, and shall notify the NRC in writing when implementation of these activities is complete and can be verified by NRC inspection.

F.

All capsules in the reactor vessel that are removed and tested must meet the test procedures and reporting requirements of the most recent NRC-approved version of the Boiling Water Reactor Vessels and Internals Project (BWRVIP)

Integrated Surveillance Program (ISP) appropriate for the configuration of the specimens in the capsule. Any changes to the BWRVIP ISP capsule withdrawal schedule, including spare capsules, must be approved by the NRC prior to implementation. All capsules placed in storage must be maintained for future insertion. Any changes to storage requirements must be approved by the NRC, as required by 10 CFR Part 50, Appendix H.
