REVIEW SCHEDULE FOR APPLICATION FOR RENEWAL OF THE OPERATING LICENSES FOR THE BROWNS FERRY NUCLEAR PLANT, UNITS 1, 2 AND 3 (TAC NOS. MC1704, MC1705 AND MC1706)

Dear Mr. Scalice:

On January 6, 2004, the staff of the U.S. Nuclear Regulatory Commission (NRC) received the Tennessee Valley Authority application for renewal of Operating Licenses DPR-33, DPR-52, and DPR-68 for the Browns Ferry Nuclear Plant, Units 1, 2 and 3, respectively. Notice of receipt of this application was published in the Federal Register on January 13, 2004 (69 FR 2012). On February 19, 2004, the staff received supplemental information on the application regarding the evaluation of Browns Ferry Unit 1 Lay-up and Preservation Program (ADAMS Accession Number ML0405102410). On March 4, 2004, the staff accepted the application for review (ADAMS Accession Number ML040650206). Notice of acceptability and sufficiency for docketing and opportunity for a hearing regarding the application was published in the Federal Register on March 10, 2004 (69 FR 11460).

This letter forwards the staffs safety and environmental review schedule for the subject application (Enclosure 1). The staff will follow established review procedures and the enclosed schedule to complete the safety and environmental reviews required by 10 CFR Parts 54 and 51, respectively. This schedule has been established in accordance with a 36-month review plan which includes time to conduct a hearing should a hearing be requested and granted.

Milestones for hearing activities are not included in the enclosed schedule because these dates are established by the Commission and the Atomic Safety and Licensing Board. This schedule has been discussed with your staff.

The NRC staff determined that an additional 6 months was needed beyond the usual 30-month schedule for license renewal application reviews because of the following reasons:

(1) evaluations of the aging effects on systems and structures in Unit 1 that were in extended lay-up condition, (2) assessment of the impact of the extended power uprate evaluations on the license renewal application reviews and (3) evaluation of the Unit 1 current licensing basis differences that are to be resolved prior to Unit 1 restart. The extended power uprate item is based on your stated intentions to submit a licensing amendment request for extended power uprate in June 2004, while the staffs review of the application for license renewal is ongoing.

Your staff indicated that the necessary information pertaining to the application for license renewal review demonstrating that the renewal evaluations bound the uprated conditions would also be submitted at that time.

I would like to stress that this is a very ambitious schedule. Nevertheless, the NRC staff will make every effort to meet the goal of this schedule. We request that you inform the staff as early as possible should potential delays arise in your support of the schedule.
