Environmental and Special Projects Section Inspection Summary Inspection on January 26-27, 1981 (Report No. 50-461/81-02)

Areas Inspected: Routine, announced inspection of the environmental protection program including management controls, environmental program conduct, program results, review of the onsite meteorological monitoring program, and a tour of Clinton Lake and the site construction activities.

The inspection involved 12 inspector-hours onsite by one NRC inspector.

Results: Of the five areas inspected, no items of noncompliance or

deviations were identified in four areas; one apparent item of noncos=

pliance was identified in one area (Paragraph 3.a - Failure to collect periphyton sample at location 7 for the first quarter of 1979 - Severity Level VI).

Management a.

Organization

,

The Illinois Power Company's (IPC) environmental protection program is administered by the Department of Environmental Affairs. The Director, Enviromental Affairs Department, reports directly to a Vice President.

The licensee is utilizing Baldwin Associates as the site con-struction contractor to implement the environmental protection requirements during construction, with the exception of the requirements related to transmission line construction activities.

Transmission line construction environmental protection require-ments are directed by the IPC manager of Clinton site activities.

The Environmental Affairs Department is responsible for all erosion and biological environmental programs. The Operations Department is responsible for all meteorological and radiological

environmental programs. The Power Production Department is

responsible for all water quality and groundwater environmental programs. The Environmental Affairs Department also performs audits of the Environmental Control Program through monthly inspections. These audits are intended to ensure implementation of commitments made in the Environmental Report and the Final Environmental Statement and to ensure compliance with the Construction Permit. The inspector reviewed audit reports for

October 1979 through January 1981. All problems identified had been resolved.

with licensee personnel. The environmental control program for construction activities, Clinton Power Station, Revision 2, dated February 22, 1978, defines responsibilities, purpose, methods, and documentation made under this program. The Environmental Af, fairs Department makes monthly reviews of licensee commitments as defined in the Environmental Report (ER), Final Environmental Statement (FES), and the Construction Permit. According to I

licensee review records, one commitment, No. 32 has been com-pleted since the last environmental inspection.3j The inspector reviewed the documentation of the completion of this commitment.

No items of noncompliance or deviations were noted.

3.

Environmental Programs Aquatic Biology a.

The inspector reviewed the collection logs for zooplankton, phytoplankton, and periphyton for the years 1979 and 1980. The inspector noted that periphyton had not been collected at location 7 during the first quarter of 1979 as required by the Construction Permit. The licensee had first attempted to collect this sample in February, but was unable due to ice conditions.

However, sampling for zooplankton and phytoplankton was done at this location in March without collecting the periphyton sample.

This constitutes an item of noncompliance.

b.

Terrestrial

The inspector reviewed the bird, animal, and vegetation censuses

and the trapping data required by the Construction Permit for the period May 1979 through April 1980. These activities were in

accordance with the Construction Permit requirements.

No items ci noncompliance or deviations were noted.

c.

Fisheries l

The inspector reviewed the fish sampling program for the period i

January 1979 through December 1980. The inspector determined

that the requirements of the Final Environmental Statement (FES)

I as referenced in the Construction Permit have been met with one exception. The FES requires that fish collected will be analyzed for lead, mercury, zinc, polychlorinated biphenyls (PCB's), and i

the most commonly used herbicides and insecticides. The licensee stopped this fish analysis in May 1980 based on a letter from Mr. R. L. Ballard, Chief Environmental Engineering Branch, l

l Division of Engineering at NRC Headquarters to Mr. G E. Wuller of IPC dated April 30, 1980. This letter stated that the aquatic pre-operational monitoring program as submitted in Section 6.1.6 of the Environmental Report (OL stage) could be implemented. program deletes the above mentioned heavy metal and pesticide analysis in fish. This item is considered unresolved pending determination of which program is legally binding.

No other items of noncompliance or deviations were noted.

d.

Site Preparation and Construction The inspector visited the site on January 27, 1981, and determined that site preparation and construction work was proceeding as authorized by the Construction Permit. Twelve licensee commitments as identified in the FES, ER, or Construction Permit remain to be fulfilled and are being monitored by the licensee.

Erosion The inspector determined that the licensee had implemented the Construction Permit required drainage and erosion control program.

Those areas shewing signs of erosion identified by the inspector

along the discharge canal were scheduled for reseeding in the spring.

No items of noncompliance or deviations were noted.

Groundwater Monitoring Groundwater monitoring is performed semiannually at several well locations to assure that local wells do not become contaminated by Clinton Lake water. The inspector reviewed the results obtained during the period January 1979 through December 1980 and determined that all required sampling had been conducted.

No items of noncompliance or deviations were noted.

4.

Onsite Meteorological Monitoring Program The preoperational meteorological program was conducted for IPC by the Research Corporation of New England up to the end of 1979. A new con-tract was issued by the licensee to Meteorological Research Incorporated to upgrade the monitoring program to the revised Regulatory Guide 1.23 requirements. This upgrade of the meteorological monitoring program is

,

scheduled to be complete by spring of 1981. During the period January 1980 through the completion of this upgrade, the calibration of current equipment and collection of data has been suspended. The failure to monitor meteorological conditions during this period is considered an unresolved item pending resolution of the above conflicting requirements.

Unresolved Items Unresolved items are matters about which more information is required in order to ascertain whether they are acceptable items, violations,
