- Clinton Power Station - License No. NPF-62 EA 98-464 During'an investigatloa conducted by the NRC Office of Investigations from October 28,1997, to September 21,1998, a violation of NRC requirem nts was identified. In accordance with the
" General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below-10 CFR SC 7 prohibits, in part, discrimination by a Commission licensee against an employee for engaging in certain protected activities. Discrimination includes discharge and other actions that relate to compensation, terms, conditions or privileges of employment. The protected activities are_ established in Section 211 of the Energy Reorganization Act of 1974, as amended, and in general are related to the administration or enforcement of a requirement 1 imposed under the Atomic Energy Act or the Energy Reorganization Act. nuclear safety..
l Contrary to the above, during January 1997, the lilinois Power Company, a Commission licensee, through the actions of a supervisor in the Quality Verification Department, discriminated against a QV inspector, an employee of the licensee, for having engaged in protected activities. Specifically, the QV inspector engaged in protected activities on October 30,1994, when she provided information regarding potential violations relating to nuclear safety to the NRC. As a result cf the protected activity, the QV supervisor did not recommend the QV inspector for promotiori to the position of lead QV inspector. (01013)

adequately addressed in a letter from the Illinois Power Company dated December 10,1998.
However, you are required to respond to the provisions of 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position. In that case, or if ,

Washington, DC 20555, with a copy to the Regional Administrator, NRC Region ill, !
801 Warrenville Road, Lisle, IL 60532-4351, and the NRC Resident Inspector at the Clinton i Power Station within 30 days of the date of the letter transmitting this Notice of Violation.
