Dear Ms. Garde:

This is in further response to your letter dated July 10, 1985, in which you requested, pursuant to the Freedom of Information Act (F0IA), access to

. documents concerning the NRC staff's review of the Quadrex Corporation's analysis of the South Texas plant, including all information that the staff relied upon in performing the analysis of the Quadrex Report, as well as the facts and circumstances under which the staff learned of the Quadrex Report and any evaluation of the same.

The released portions of the documents listed on Appendix B are being placed in the NRC Public Document Room filed in folder FOIA-85-519 under your name.

Portions of documents 1 through 23 on the enclosed Appendix B have been deleted in order to withhold the names and personal identifier infonnation of individuals. Because release of this information would constitute an unwarranted invasion of personal privacy and would identify confidential sources, it is being withheld from public disclosure pursuant to Exemptions (7) (C) and (D) of the~ F0IA (5 U.S.C. 552(b)(7)(C) and (D) and 10 CFR 9.5(a)(7)(iii) and (iv) of the Commission's regulations.

The document listed on Appendix C is a draft document containing predecisional advice, opinions, and recommendations of the staff. This document is being withheld from public disclosure pursuant to Exemption (5) of the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations.

Pursuant to 10 CFR 9.9 of the Connission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for the denial of documents 1 through 23 on Appendix B, and document one on Appendix C are the undersigned and Mr. Robert D. Martin, Regional Administrator, Region IV, Arlington, Texas.

Dear Mr. Dircks:

This letter appeals the effective denial of the Freedom of Information Request filed June 19, 1985 in which I requested all information relevant to or generated in connection with the staff's review of the Quadrex Corporation's analysis of the South Te'xas nuclear power plant. The request was also for all information that the staff relied upon in performing the analysis of the Quadrex report, as well as the facts and circumstances under which the staff learned of the Quadrex report and any evaluation of the same.

By letter from Ms. Linda Robinson, Chief of the FOIA and Privacy Act Branch of the Divison of Rules and Records dated June 25, 1985 I was informed that the staff had received my request,

.given it the processing number of 85-455, and assigned it to Mr.

Frank Karas.

On July 11, 1985 Mr. Karas informed me by telephone that the only document in the staff's possession responsive to my request was the NUREG that covers the Quadrex report. As of this date I have not received written notification of that position.

As stated above this letter serves as an appeal of the effective denial of my request.
