Dear Mr. Winslow:

This is in response to your letter dated May 9, 1988 requesting a one-time exemption from the comitment contained in your currently approved Fundamental Nuclear Material Control Plan (FNMCP) to perform on-site receipt measurement of low enriched uranium and the subsequent, if necessary, resolution of shipper /

receiver differences.

We have detennined that the procedures outlined in the attachment to your letter dated May 9,1988 for the General Electric measurement verification (including shipper / receiver difference resolution) of U0, pellets at the Babcock and Wilcox Comercial Nuclear Fuel plant located at Lynchburg, Virginia prior to the pellets being shipped to your facility for reprocessing are acceptable. We have further determined that the granting of your request will not adversely affect the comon defense and security nor the public health and safety and is otherwise in the public interest. Accordingly, we are hereby adding Temporary License Condition 4.2, effective imediately, to Safeguards Amendment SG-2 to your License No. ShM-1097 to read as follows:

TC(MC&A)4.2 - Notwithstanding the comitments contair.ed in Sections 7.1 and 7.2.1 of the licensee's currently approved FNMCP to measure receipts and resolve shipper / receiver differences the licensee may, regarding the scrapping of PWR Dairyland fuel bundles, fol. low the procedures outlined in the attach- l ment to their letter dated May 9, 1988. )

4 We have detennined that the Attachment to your letter dated May 9,1988 contains 1 information of the type specified in 10 CFR 2.790(d). Accordingly, pursuant to Section 2.790(d)(1), such information is deemed to be comercial or financial within the meaning of 10 CFR 9.5(a)(4) and shall be withheld from public disclosure unless subject,to the provisions of 10 CFR 9.12.
