NOTICE OF VIOLATION Wolf Creek Nuclear Operating Corporation Docket: 50-482 Wolf Creek Generating Station License: NPF-42 During an NRC inspection conducted on June 23 and July.1,1987, two violations l of NRC requirements were identified. These violations involved a failure to  ;

notify NRC of an inability to meet certain ASME Code requirements and a failure I to perform a containment purge system surveillance. In accordance with the

" General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C (1987), the violations are listed below:

A. Failure To Comply With Technical Specification (TS) 4.0.5 Technical Specifications 4.0.5 requires, in part, that, ". . . Inservice testing of ASME Code Class 1, 2, and 3 pumps and valves shall be performed in accordance with Section XI of the ASME Boiler and Pressure Vessel Code and applicable addenda as required by 10 CFR Part 50, l Section 50.55a(g) . . . ." l Section 50.55a(g)(5)(iii) cf 10 CFR Part 50 requires, "If the licensee has i determined that conformance with certain code requirements is impractical for its facility, the licensee shall notify the Commission . . . ."

Contrary to the above, on June 23, 1987, the NRC inspector, through a routine review of work requests and discussions with licensee personnel, became aware that a section of safety-related, ASME Code Class 3, piping downstream Valve EFV090 had not been properly pressure tested after a through-wall repair and would not be tested until next refueling outage.

The licensee had failed to notify the Commission.

This is a Severity Level IV violation. (Supplements)(482/8715-01)

B. Violations of Technical Specifications-Containment Purge System Surveillance TS Surveillance 4.3.3.11 requires that, "Each radioactive gaseous effluent monitoring instrumentation channel shall be demonstrated OPERABLE by performance of the CHANNEL CHECK, SOURCE CHECK, CHANNEL CALIBRATION, and ANALOG CHANNEL OPERATIONAL TEST at the frequencies shown in Table 4.3-9."

Step 3.a of Table 4.3-9 requires that, quarterly, the Analog Channel Operational Testmonitor noble gas activity (ACOT)GT-RE33) be p(erformed for alarm providing the containment purge system and automatic termination of release, and that the ACOT shall also demonstrate that automatic isolation of the containment purge pathway occurs when the instrument indicates measured levels above the Alarm-Trip Setpoint.

Contrary to the above, on July 1,1987, the licensee determined that TS Surveillance 4.3.3.11 was net adequately performed between October 1985 8707290037 870722 PDR ADDCK 05000482 O PDR

2 and October 1986 and between December 1986 and June 1987, in that, the surveillance procedure for performing this surveillance, STS IC275B, Revision 4, " Analog Channel Operational Test Containment Purge System Radiation Monitor GE RE33," failed to demonstrate that automatic isolation of the containment purge pathway occurred when radiation monitor (GT-RE33) indicated measured levels above the Alarm Trip /Setpoint. This violation is a repeat of Violations 482/8541-03 and 482/8634-02.

This is a Severity Level IV violation. -(Supplement I)(482/8715-02)-

Pursuant to the provisions of 10 CFR 2.201, Wolf Creek Nuclear Operating Corporation is hereby required to submit a written statement or explanation to i the U.S. Nuclear Regulatory Commission, ATTN: Document Centrol Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region IV, and if applicable,'a copy to the NRC Resident Inspector, within 30 days of the date of the letter transmitting this Notice. This reply, should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: -(1) the reason for the violation if admitted, (2) the corrective l steps that have been taken and the results achieved, (3) the corrective steps l that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked or why such other action l as may be proper should not be taken. Where good cause is shown, consideration I will be given to extending the response time.
