- NOTICE OF VIOLATION Wolf Creel: Nuclear Operating Corporation l Docket No.:' 50-482 WoGreek Generating Station License No.: NPF-42 lDuring'an NRC inspection conducted on October 20-24,1997, three violations of NRC.

requirements were identified.- In accordance_with the " General Statement of Policy and.  ;

Procedure for NRC Enforcement Actions," NUREG 1600, the violations are listed below:

A_ 10 CFR 20.1003 defines a high radiation area as an area, accessible to individuals, in which radiation levels could result in an individual recaiving a dose equivalent in

excess of 100 millirems in i hour at 30 centimeters irom the radiation source or from any surface that radiation penetrates.10 CFR 20.1902(b) requires the licensee to post r. nigh radiation area with a conspicuous sign or signs bearing the'.

radiation symbol and the words, " Caution, high radiation area."

Technical Specification 6.12.2 requires, in part, that areas accessible to personnel wi.h~ radiation of greater than 1000 millirems per hour.shall be provided with locked

. - doors to prevent unauthorized entry or, where no enclosure exists for the purpose of locking and no enclosure can be reasonably constructed around the individual area,-

that individual area be barricaded, conspicuously posted, and a flashing light'shall be ,

activated as a warning device.

Contrary to the above October 12 13,1997, an area above Filter FHB11 with radiation levels greater than 1000 millirems per hour was not conspicuously posted

- as a high radiation area and a flashing light was not activated as a warning device.

This is a Severity Level IV violation (Supplement IV)(482/9720-01).

B. Technical Specification 6.8.1.a requires, in part, that written procedures be established, implemented, and maintained covering the procedures recommended in Appendix-A of Regulatory Guide 1.33, Revision 2, February 1978. Section 7.e.(4)'

lists radiation protection procedures for contamination control.

1. Procedure RPP 02 515, *' Release of Material From the RCA," Revision 8, Section 9.4.1 states, in part, " Material HQI meeting the unconditional release criteria may be taken outside the normally established RCA. Form RPF 02 515-02 is used for conditional release of items." Section 9.4.1.d
states, in part, "The item must be labeled . . . ."

2. Procedure RPP 02 215, " Posting of Radiological Controlled Areas,"

Revision 1 ?, Section 9.1.1 states, in part, " Area Postings are shown in Attachment A." Attachment A of the procedure requires that an area be

- posted if ccitamination levels are equal to er greater than 1000 disintegrations per minute per 100 centimeters squared (beta / gamma).

Section 9.1.2 states, in part, " Posted areas must be clearly and conspicuously mreked at all accessible sides and entran:es."

Contrary to the above, on or about August 7,199'/, an area around the spent fuel pool with contamination levels equal to or greater than 1000 disintogra: ions per minute per 100 centimeters squared (beta /genma) was not conspicuously marked on all accessible sides.

This is a Severity Level IV violation (Supplement IV)(482/9720-03).

- Pursuant to the provisions of 10 CFR 2.201, Wolf Creek Nuclear Operating Corporation is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region IV,611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011, and a copy to the NRC Resident inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the correc.tivo steps that will be taken to avoid further violations, and (4) the date when full compliar e will be achieved. Your response may reference or include previous docketed ce,irespondence, if the correspondence adequately addresses the required response, if an adequate reply is not received within the time specified in this Notice, an order or a Demand for information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.

Because your response will be placed in the NRC Public Document Room (PDR), to the extent possible, it should not include any persona privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction. However, if you find it necessary to include such information, you should clearly indicate the specific information that you desire not to be placed in the PDR, and provide the legal basis to support you, request for withholding the information from the public.
