Dear Senator Helms:

This letter is in response to your letter of April 24, 1987, to the U. S.

Nuclear Regulatory Commission (NRC), in which you enclosed a letter from Mr. B. N. Case concerning a recent senior reactor operator's examination which he failed. Mr. Case has appealed the grading of the simulator examination that he felt was poorly administered and unfairly graded.

Mr. Case's appeal is currently under review in the Office of Nuclear Reactor Regulation. It is presently being personally reviewed by the Director, Division of Licensee Performance and Quality Evaluation, who is responsible for the conduct of NRC administered operator licensing examinations. It is our intention to complete an impartial and objective review of Mr. Case's appeal by June 19, 1987. If we determine that his exam was poorly administered or graded unfairly, appropriate corrective measures will be l taken, including giving Mr. Case another opportunity to pass the portion of the examination that he failed and is contesting.

The NRC process for review of operator licensing examination appeals is multi-layered to assure that concerns of candidates are addressed and resolved expeditiously and impartially. If Mr. Case's examination failure is upheld at the current level of review, he will have the further option of requesting a hearing under 10 CFR Part 2 of our regulations.

NRC examination procedures require a two-tier admin istrative / process.

review It commences with a review of the examination fapure by the cognizant regional office staff, and, if the failure is upheld, the applicant may carry the appeal process to the next level or review'by NRC headquarters staff.

The process is designed to provide a fair li, censing decision to each license applicant, while protecting the public health and safety by ensuring that only competent personnel are licensed as,r'eactor operators. Mr. Case's appeal is currently being processed in pccordance with the Operator Licensing Examiner Standards, NUREG-1021, to ensore an impartial and objective review.

If his examination failure is upheld 4y the headquarters staff review, he will have the further option of req 6esting a hearing before an administrative law judge for final disposition.

The established procedure will ensure that Mr. Case's concerns are addressed and resolved expeditiously /an'd impartially.
