Dear Mr. Davis:

The NRC has received your license termination plan dated May 15,1997, and has placed a notice of that receipt in the Federal Register. 62 Fed. Reg. 43559 (August 14, 1997).

The regulations in 10 CFR I 50.82 state that the license terrnination plan will be approved by license amendment. See 10 CFR i 50.82(a)(10). The NRC staff does not believe that your filing constitutes an application for amendment pursuant to 10 CFR I 50.90. Ynu should, therefore, file an application for amendment that complies with the appropriate sections of the Commission's regulations, including addressing the criteria for no significent hazards consideration, as required by 10 CFR i 50.91.

In your letter forwarding your License Termination Plan, you request that the NRC complete its review within nine months. The staff wlil need your license amendment application in order to complete its review.
