REQUEST TO REVISE PLANT TECHNICAL SPECIFICATIONS TO PROVIDE FOR TESTING TO CONFIRM OPERABILITY OF SHUNT AND UNDERVOLTAGE TRIP DEVICES OF CONTROL R0D DRIVE TRIP BREAKERS - DAVIS BESSE NUCLEAR POWER STATION By letter dated May 29,1985 (Serial No.1155) Toledo Edison Company (TED) requested the subject revision to the Davis-Besse Technical Specifications.

In the Significant Hazard Consideration analyses portion of the application, a No Significant Hazards Determination was made by analogy to one of the examples provided to the NRC staff (48 FR 14870). The examples provide the staff with guidance concerning the application of the standards in 10 CFR 50.92. However,10 CFR 50.91(a)(1) specifically requires the licensee requesting an amendment to provide an analysis using the three standards in 10 CFR 50.92(c). The basis for the requirement is that before the proposed amendment is submitted, the licensee has completed the safety evaluation.

The licensee knows, based on the technical evaluation, whether the proposed amendment satisfies the three standards and should be able to present sound reasons to support the detennination. The licensee may discuss examples to i assist the staff in its analysis, but the discussion does not relieve the licensee of the requirements to address the three standards in 10 CFR 50.92(c).

Toledo Edison is therefore requested to submit an amended request incorporating a revised Significant Hazard Consideration analysis, or inform the staff of the desired disposition of the May 29, 1985 amendment request.
