This is in response to your letter and enclosure LA 85-95, dated November 27, 1985, in which you submitted revised Chapters 3.0 and 4.0 to your Fundamental Nuclear Material Control Plan (FNMCP).

We have reviewed your submittal and found the revised FNMCP chapters acceptable. We have also determined that the granting of your request, to incorporate the revised chapters 3.0 and 4.0 into your FNMCP, will not adversely affect the common defense and security nor the public health and safety, and is otherwise in the public interest. Accor" ,, e y , we a re revising License Conditions 2.1, 4.3 and 4.4, and deleting Condition 4.4.1 to Amendment SG-2 of your License No. SNM-1107; effective immediately. It should be noted that the revision to Condition 2.1 also incorporates the revised FNMCP pages submitted to the NRC Region II Office by your letter LA 85-64, dated September 1,1985, and made pursuant to the provisions of 10 CFR 70.32(c). The deletion of Condition 4.4.1, and the revision of Condition 4.4 deleting the reference to Condition 4.4.1, is being made because the desired commitment is now contained in your FNMCP. Revised Conditions 2.1, 4.3 and 4.4 read as follows:

2.1 The licensee shall follow Chapters 1.0 through 8.0 and Appendices A, B, C, D, and AA of its Fundamental Nuclear Material Control Plan dated April 18, 1984, except as noted in Condition 2.1.2 below; as revised by its submittals dated September 1, 1984 (revised pages labelled as Revision 1), December 1,1984 (revised pages labelled as Revision 2), March 1,1985 (revised pages labelled as Revision 3),

June 1,1985 (revised pages labelled as Revision 4), September 1, 1985 (revised pages labelled as Revision 5), and November 27, 1985 (chapters 3.0 and 4.0 in their entirely with pages labelled Revision 7); as amended by its submittal (for Appendix AA) dated December 1, 1984; and as may be revised in accordance with the provisions of 10 CFR 70.32(c). All revised pages associated with the above stated revisions are identified by, and are in accordance with, the

" Schedule of Revisions" as contained in pages ix through xiii of the Plan described above.

Sanders 4.3 Notwithstanding the requirement of 10 CFR 70.57(b)(11) to establish and maintain control charts and control limits for all SNM accountability measurements, the licensee need not maintain control charts (or logs) and control limits for control standard measurements and/or replicate measurements in those cases where such measurements are shown as

" exempt" or "not required" in Figure 3.1, 3.2 and 3.3 of the Plan identified in Condition 2.1.

4.4 Notwithstanding 10 CFR 70.57(b)(11) which requires all control chart limits to be set at the 0.05 and 0.001 levels of significance, the licensee shall follow Section 4.5.2 of the Plan identified in Condition 2.1.

It has been determined that both the attachment and enclosure to your LA 85-95 letter of November 27, 1985 contain information of the type specifled in 10 CFR 2.790(d). Accordingly, pursuant to Section 2.790(d)(1), such infor-mation is deemed to be commercial or financial within the meaning of 10 CFR 9.5(a)(4) and shall be withheld from public disclosure unless subject to the provisions of 10 CFR 9.12.
